سودی لین دین کرنے والے شخص سے تنخواہ وصول کرنے کا حکم
(ترجمہ)
سوال:
سوال عام ملازمت اور نوکریوں کے بارے میں ہے کہ جن کی دی جانے والی تنخواہ سود سے ادا کی جاتی ہے یا اس کا کوئی حصہ سود میں سے ہوتا ہے کیونکہ یہ بات سب جانتے ہیں کہ تنخواہ دینے والی ریاست آئی ایم ایف اوردوسرے ملکوں سے سودی قرضے لیتی ہے۔
کیا ہم ملازمین جو اپنے کام کے بدلے میں تنخواہ لیتے ہیں، وہ سود ہے یا نہیں؟ اگر جواب ہاں میں ہے تو کیا پھر ان سے جان چھڑانے اوران نوکریوں کے بغیر زندگی گزارنے کا کوئی راستہ ہے، ہم نے تو عمریں یہی تعلیم حاصل کرنے اور کام کرنے میں ضائع کردیں؟ شکریہ پہلے ہی قبول کیجئے اور اللہ ہماری طرف سے آپ کو جزائے خیر دے، آپ کا بھائی عمار تیونس۔
جواب:
وعلیکم السلام ورحمۃ اللہ وبرکاتہ،
جہاں تک اس تنخواہ کی بات ہے جو عام سرکاری ملازم اپنے کام کے بدلے میں ریاست سے لیتے ہیں، اس کا تعلق اس کے کام سے ہے:
– اگر وہ کام حرام ہے جیسے وہ مسلمانوں کی جاسوسی کےلیے انٹیلی جنس ایجنسی میں کام کرتا ہویا اسلام کی دعوت کے علمبرداروں پر تشدد کرتا ہو وغیرہ، تو اس کی تنخواہ حرام ہے کیونکہ یہ حرام کام کے ذریعے کمائی ہے۔
– اگر وہ کام کوئی مباح کام ہوجیسے کوئی ٹیچر، انجنئیر اور سرکاری ہسپتال میں ڈاکٹر ہو یا ان جیسے کوئی بھی کام کرتا ہو تو اس کی تنخواہ مباح ہے کیونکہ یہ کام مباح ہیں،اس کو تنخواہ دینے والے چاہے جس مال سے بھی اس کو تنخواہ دیں، اسے کوئی نقصان نہیں ۔تنخواہ دینے والے سودی معاملات کرتے ہوں یا جائز، اس کے لیے اپنے کام کے بدلے تنخواہ لینا جائز ہے سوائے اس کے کہ اس کی تنخواہ چوری شدہ مال یا غصب کیے ہوئے مال یا اس مال سے جس کی عین ہی حرام ہو جیسے خنزیر یاشراب، سے ادا کی جائے،ایسی تنخواہ حرام ہے اس کی تفصیل یوں ہے:
حرام اموال کی درج ذیل اقسام ہیں:
حرام لِعَیْنہٖ۔۔۔وہ جو بذاتِ خود حرام ہے جیسا کہ شراب ۔اس میں سے ہدیہ لینا، اجرت لینا،اس کی خرید وفروخت کرنا جائز نہیں۔ یہ شراب والے کے لیے بھی حرام ہے اور اس کے لیے بھی جواس سے شراب لیتا ہے، رسول اللہ ﷺ نے فرمایا: «حُرِّمَتِ الْخَمْرُ بِعَيْنِهَا» "شراب کی حرمت اس کے عین کے ساتھ ہے”النسائی۔
کسی دوسرے آدمی کا حق ہونے کی وجہ سے کسی مال کاحرام ہونا ،یعنی چوری شدہ یا غصب کردہ مال ،یہ چوری کرنے والے یا غصب کرنے والے کے لیے حرام ہے، اس مال کا ہدیہ بھی جائز نہیں۔ یہ مال جس کے پاس ہے اس کا حق ہی نہیں، یہ اس کو کمانے والے کے لیے بھی حرام ہے اور لینے والے کے لیے بھی۔ یہ مال جہاں پایا جائے اس کے مالک کا ہی ہے اس کے دلائل یہ ہیں:
احمد نے سمرہ سے روایت کی ہے کہ رسول اللہ ﷺ نے فرمایا:«إِذَا سُرِقَ مِنَ الرَّجُلِ مَتَاعٌ، أَوْ ضَاعَ لَهُ مَتَاعٌ، فَوَجَدَهُ بِيَدِ رَجُلٍ بِعَيْنِهِ، فَهُوَ أَحَقُّ بِهِ، وَيَرْجِعُ الْمُشْتَرِي عَلَى الْبَائِعِ بِالثَّمَنِ» "کسی آدمی کا مال چوری کیا گیا یا اس کا مال کھو گیا، پھر یہ اس نے یہ مال بعینہ کسی آدمی کے پاس پایاتو یہی اس کا حقدار ہے اسے بیچنے والا خریدنے والے کو قیمت واپس کرے گا”۔ یہ اس بارے میں نص ہے کہ کہ چوری شدہ مال مالک کو واپس کیا جائے گا۔
اسی طرح غصب شدہ مال کا معاملہ ہے،غصب کرنے والے کے لیے وہ مال اس شخص کو واپس کرنا لازمی ہے جس سے اس نے غصب کیا تھا۔ ترمذی نے سمرہ سے روایت کرتے ہوئے کہا ہے کہ یہ حسن حدیث ہے کہ نبی ﷺ نے فرمایا: «عَلَى اليَدِ مَا أَخَذَتْ حَتَّى تُؤَدِّيَ» "لینے والے کو جو کچھ لیا ہے واپس دینا پڑے گا”۔
–باطل معاملات کی وجہ سے حرام جیسے سود اور جوئے کا مال ۔۔۔اگر کسی شخص کے پاس سودی اور حلال مال مخلوط طور پر ہو تو اس میں سے صرف سود کا مال کمانے والے کے لیے حرام ہے باقی حلال ہے، یہ حرام اس شخص تک نہیں پہنچتا جس نے سود یا جوئے والے سے جائز طریقے سے کچھ کمایا جیسے کوئی سودی لین دین کرنے والے شخص کو کوئی چیز بیچ کر اس کی قیمت وصول کرے یا عورت سود خور سے اپنا نفقہ وصول کرے یا یہی سود خور کسی رشتہ دار کو ہدیہ دے، یا اس جیسا کوئی جائز لین دین کرے، اس مال کا گناہ اس سودی لین دین کرنے والے پر ہے ،اپنی چیز کی قیمت لینے والے یا نفقہ لینے والی یا ہدیہ قبول کرنے والے پر نہیں، کیونکہ اس حال میں حرام دو بندوں کے ذمے نہیں ہوتا اس کے دلائل یہ ہیں:
1۔ ﴿وَلَا تَكْسِبُ كُلُّ نَفْسٍ إِلَّا عَلَيْهَا وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى﴾ "آدمی جو بھی کرتا ہے اس کا وبال صرف اسی پر ہے کوئی بوجھ اٹھانے والے کسی دوسرے کا بوجھ نہیں اٹھائے گا”۔
2۔ رسول اللہ ﷺ مدینہ میں یہود کے ساتھ تجارت کرتے تھے اور یہ بھی جانتے تھے کہ ان کے زیادہ تر اموال سود سے کمائے ہوئے تھے، اللہ تعالی فرماتا ہے: ﴿فَبِظُلْمٍ مِنَ الَّذِينَ هَادُوا حَرَّمْنَا عَلَيْهِمْ طَيِّبَاتٍ أُحِلَّتْ لَهُمْ وَبِصَدِّهِمْ عَنْ سَبِيلِ اللَّهِ كَثِيرًا* وَأَخْذِهِمُ الرِّبَا وَقَدْ نُهُوا عَنْهُ وَأَكْلِهِمْ أَمْوَالَ النَّاسِ بِالْبَاطِلِ﴾ "یہود کے ظلم، اللہ کی راہ سے بہت زیادہ روکنے،سود لینے جس سے ان کو منع کیا گیا تھا اور لوگوں کے اموال باطل طریقے سے کھانے کی وجہ سے ہم نے ان پاک چیزوں کو ان پر حرام کردیا جو ان کے لیے حلال تھیں”۔ آپ ﷺ ان سے ہدیہ قبول کرتے تھے جیسا کہ احمد نے ابنِ عباسؓ سے روایت کی ہے کہ : ” ایک یہودی عورت نے نبی ﷺ کو ایک پوری بکری(گوشت) ہدیہ کی جس میں زہر ملایا تھا، آپ ﷺ نے اس عورت کو پیغام بھیجا کہ "تم نے ایسا کیوں کیا؟” اس نے کہا: میں یہ دیکھنا چاہتی تھی کہ اگرآپ واقعی نبی ہو تو اللہ آپ کو بتا دے گا ،اگر نہیں تو لوگوں کی جان چھوٹ جائے گی”۔
3۔ صحابہ کرام ؓاور تابعین سے ثابت ہے کہ انہوں نے سودی لین دین کرنے والے سے ہدیہ قبول کرنے کو جائز قرار دیا ہے۔
ا۔ایک شخص ابن مسعودؓ کے پاس آیا اور کہا: میرا ایک پڑوسی ہے جو سودی لین دین کرتاہے اوروہ مجھے بار بار دعوت دیتاہے آپ نے فرمایا:”اس کا وبال اس پر ہے اور مزہ تمہارا ہے” اس کو عبد الرزاق صنعانی نے اپنی مصنف میں ذکر کیا ہے۔
ب۔ حسن بصری سے پوچھا گیا کہ صیارفہ(صرافوں/ منی چینجرز) کا کھانا کھانا جائز ہے؟ فرمایا: ” اللہ نے تمہیں یہود ونصاری کے بارے میں خبر دی ہے کہ وہ سود کھاتے ہیں اور ان کے کھانے کو تمہارے لیے حلال قرار دیا ہے” اس کو عبد الرزاق صنعانی نے اپنے منصف میں معمر سے روایت کیا ہے۔
ج۔منصور سے روایت ہے کہ انہوں نے کہا: میں نے ابراھیم سے کہا: میں ایک مزدور کے گھر گیا، اس نے میری دعوت کی اور مجھے پیسے پیش کیے۔ ابراھیم نے کہا: "لے لو”، لہٰذا منصور نے کہا: یہ مزدور سود لیتا ہے۔ ابراھیم نے کہا: "اگر تم اسے سودی لین دین کا حکم نہیں دیتے یا اس میں مدد نہیں کرتے تو لے لو” (اس کو عبد الرزاق صنعانی نے اپنے مصنف میں معمر سے روایت کیا ہے)
4۔ اس سب کے باوجود افضل یہ ہے کہ اس شخص کے ساتھ لین دین نہ کیا جائے جس کے مال میں سود شامل ہو،اسے نہ کچھ بیچا جائے اور نہ اس کا ہدیہ قبول کیا جائے تا کہ فروخت کرنے والا اپنے سامان کی ایسی قیمت وصول نہ کرے جو سود میں ملوث ہو،نہ ہی اس کےسودی اموال میں سے ہدیہ قبول کیا جائے کیونکہ یہ تقویٰ کے خلاف ہے۔
مسلمان کو ہر اس چیز سے دور رہنا چاہیے جو بالکل صاف اور پاک نہ ہو، رسول اللہ ﷺ کے صحابہ حرام سے بچنے کے لیے بہت سارے مباح چیزوں سے بھی اجتناب کرتے تھے، آپ ﷺ نے فرمایا کہ:” بندہ اس وقت تک متقی نہیں ہوسکتا جب تک ان چیزوں سے بچنے کے لیے جن میں حرج ہے ان چیزوں کو بھی ترک نہ کرے جن میں حرج نہیں”اس کو ترمذی نے روایت کیا اور حسن قرار دیا ہے۔
خلاصہ: اس شخص کو کچھ بیچنا جائز ہے جس کا مال سود اور حلال دونوں سے مخلوط ہے، اس کا ہدیہ بھی قبول کرنا جائز ہے، اس شخص سے اپنی تنخواہ لینا بھی جائز ہے مگر افضل یہ ہے کہ اس سے لین دین نہ کیا جائے، اس کا ہدیہ قبول نہ کیا جائے، اس کے پاس کام نہ کیا جائے نہ ہی اس سے تنخواہ لی جائے، اسی لیے عام ملازمتیں لینا مباح ہے اس شخص سے تنخواہ لینا مباح ہے جس کا مال حلال اور سود دونوں کا مجموعہ ہو یہ تنخواہ مباح ہے اس کو لینے میں کوئی حرج نہیں۔۔۔اس سود کا گناہ اس ملازم پر نہیں بلکہ لین دین کرنے والے پر ہے اس کا وبال ملازمت کرنے والے پر نہیں۔
