خلیفہ اورعبوری امیر سے متعلق احکامات
(عربی سے ترجمہ)

سوال:
السلام علیکم و رحمۃ اللہ و برکاتہ، میرے پیارے بھائی اور ہمارے معزز امیر، میں اللہ سے آپ کے لئے برکات اور بھلائی کا دعا گو ہوں۔
میں اپنی کمزور عربی زبان کے لئے آپ سے معذرت کرنا چاہتا ہوں، تاہم میں عربی میں ہی خلافت کے موضوع سے متعلق اپنا سوال پیش کرنے کی کوشش کروں گا۔
اول: کتاب "اسلام کا نظام حکمرانی” میں یہ بیان کیا گیا ہے کہ مسلمانوں کے بیعت کے ذریعے منتخب حکمران کا لقب خلیفہ، امام اور امیر المومنین ہو سکتا ہے، اور ایسا لقب بھی جومعنی کے اعتبار سے ان جیسا ہی ہے، جیسے کہ سلطانُ المومنین ۔ لیکن ریاستِ خلافت کی حکومتی اور انتظامی تنظیم کی کتاب "اجھزہ” میں صرف "امیر المومنین” کے لقب کا ذکر ہے اور اس میں دوسرے القابات کا تذکرہ نہیں کیا گیا ہے۔ کیا خلیفہ کے القابات پر ہماری تبنی میں کوئی تبدیلی آئی اور کیا یہ صرف ان تین تک محدود ہے؟ اگر تبدیلی آئی ہے تو اس تبدیلی کی دلیل کیا ہے؟
دوئم: جیسے کہ کتاب "اجھزہ” میں عمرؓ کو دیے جانے والے لقب امیر المومنین کی وجہ کا تذکرہ کیا گیا ہے، کیا یہ کہنا درست ہے کہ یہ اجازت صرف اس لقب تک ہی محدود ہے؟ کیا امیر المومنین کے لقب کے علاوہ اس جیسے دوسرے القابات جیسے کہ "سلطان المومنین” کا استعمال کرنا جائز ہے؟
سوئم: میری سمجھ کے مطابق صحابہ کرام کے اجماع کے لئے ایک شرط یہ ہے کہ کسی عام فہم والے حکم کے ساتھ تضاد کی صورت موجود ہو، جیسے رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کی تدفین ملتوی کرنا اور اس کے مقابلے میں میت کو فوراً دفن کرنے کی ضرورت کا ہونا۔ تو پھر حضرت عمر رضی اللہ عنہ کو امیر المومنین کا لقب دینے میں تضاد کہاں ہے، کہ اسے صحابہ کرام کا اجماع سمجھا جائے؟
چہارم: آپ نے ماضی میں ایک سوال کا جواب دیا اور کہا کہ "خلیفہ” کی اصطلاح فقہی شرعی اصطلاح تھی ، لہذا کیا "امام” کی اصطلاح کے بارے میں بھی یہی بات ہو سکتی ہے یعنی اسے بھی فقہی شرعی اصطلاح قرار دیا جاسکتا ہے؟ اصطلاح کا چونکہ ذکر شرعی دلائل میں ہے، یا کیا ہم یہ کہتے ہیں کہ لفظ "امام” بھی اصطلاح ہے؟ اس معاملے کے بارے میں ، بہت ساری احادیث میں، "امام” کی اصطلاح کا ذکر کیا گیا ہے اور اس سے مراد وہ ہے جو لوگوں کی نمازمیں امامت کرواتا ہے۔ کیا اس کے معنی میں کوئی فرق ہے جیسے کہ یہاں مراد لی گئی ہے؟ یعنی کیا ان احادیث کے معانی صرف خلیفہ اور والیوں تک محدود ہیں کہ جنہیں خلیفہ مقرر کرتا ہے اور امراء وغیرہ، یا اس میں وہ لوگ بھی شامل ہیں جو مسلمانوں کی نماز کی امامت کرواتے ہیں جیسا کہ آج کل ہم اماموں کو اپنی مساجد میں دیکھتے ہیں؟
پنجم: "عبوری امیر” کے معاملے میں، خلیفہ کی تقرری میں معاون تنفیذ کو کیوں نہیں ذمہ دار کیا گیا؟ اس کے علاوہ، خلیفہ کی تقرری کی ذمہ داری کو ادا کرنے کے لیے سب سے عمر رسیدہ معاون کا انتخاب کرنے کی کیا بنیاد ہے؟ معاون کی حیثیت سے ان کے مقابلے میں زیادہ قابلیت والا معاون کیوں نہیں منتخب کیا جاتا، جو انصاف کے حوالے سے زیادہ بہتر ہو یا قرآن کے علم میں ان سے زیادہ بہتر ہو، وغیرہ وغیرہ؟
میرا ایک اور سوال ہے ، اور وہ یہ کہ اگر خلیفہ اپنی تقرری کے بعد اپنی بیعت میں سے کسی ایک شرط کی خلاف ورزی کرتا ہے تو کیا اس کا اس عہدے پر قائم رہنا جائز ہوگا؟ یعنی، مثال کے طور پراگر وہ ظالم بن جائے، یا اس شخص کی طرح ہوجاتا ہے جس کے بارے میں رسول اللہ صلی اللہ علیہ وسلم بیان کرتے ہیں کہ ایسا امام کہ جس سے مسلمان نفرت کرتے ہیں۔

میں آپ کے جوابات کا بہت مشکور ہوں گا، اور میں اللہ سے دعا گو ہوں کہ وہ آپ کو ، آپ کے اہل خانہ اور بھائیوں کو خیر وبرکت ، اچھی صحت اور ایک مبارک ماہ رمضان عطا کرے۔

السلام علیکم ، سلامتی ہو آپ پر۔
مجھے خوشی ہوئی کہ آپ نے مجھے قرآن کریم کی زبان ، عربی میں لکھا، اس کے باوجود کہ آپ کو اس میں لکھنا مشکل لگتا ہے۔ آپ کے سوالات واضح ہیں، اگرچہ کچھ مقامات مزید وضاحت طلب ہیں۔ آپ کے سوالوں کے جوابات یہ ہیں:
1-: خلافت کی بیعت کرنے والوں کو دیئے گئے القابات خلیفہ، امام، یا امیر المومنین ہیں، جیسا کہ رسول اللہ صلی اللہ علیہ وسلم کی احادیث اور صحابہ کرام کے اجماع سے ثابت ہے۔ جہاں تک اس کا تعلق ہے جوکچھ ان تینوں کے علاوہ حکمرانی کے نظام کی کتاب میں لکھا گیا ہے: "ان تینوں القابات کی پابندی کرنا واجب نہیں ہے، بلکہ جو بھی مسلمانوں پر ذمہ داری قبول کرتا ہے اس کو مختلف القابات دینا جائز ہےجن سے اصل معنی کی نشاندہی ہوتی ہو، جیسے حاکم المومنین، یا رئیس المسلمین، یا سلطان المسلمین یا دوسرے القابات جو اصل معانی سے متصادم نہیں ہیں۔ جہاں تک کہ ان القابات کا تعلق ہے، جن کے مخصوص معنی ہیں، جو حکمرانی سے متعلق اسلام کے اصولوں سے متصادم ہیں، جیسے بادشاہ اور صدرِ جمہوریہ، (اور شہنشاہ)، ان عنوانات کو کسی ایسے فرد کے لئے استعمال کرنا جائز نہیں ہے جو اسلام کے مطابق مسلمانوں پر اقتدار سنبھالے، کیونکہ وہ اس تصور سے متصادم ہیں جو اسلام کے احکامات سے ظاہر ہوتا ہے”۔
اسی طرح کتاب "اسلامی شخصیت” جلد دوئم کے خلافت سے متعلق باب کے پیراگراف کے آخر میں تذکرہ کیا گیا ہے کہ "اس اصطلاح کا استعمال ضروری نہیں ہے، یعنی امامت یا خلافت، بلکہ اس کے معانی درست ہونا ضروری ہیں”۔
بعد ازاں ان دونوں اقتباسات میں ترمیم کی گئی ، اور حکمرانی کے نظام کی کتاب اور اسلامی شخصیت کی کتاب جلد دوم میں مذکورہ بالا اضافی معلومات کو حذف کردیا گیا، اور کتاب "اجھزہ” میں موجود تینوں القابات، خلیفہ، امام، امیر المومنین باقی رہے، اور یہ تینوں القابات وہ ہیں جو آئندہ آنے والی اسلامی ریاست میں استعمال ہوں گے جب اللہ سبحانہ وتعالی ہمیں اپنی طرف سے نصر عطا فرمائیں گے۔
2-: اجماع سکوتی کے کسی حکم شرعی پر قابلِ قبول ہونے کیلئےشرعی حکم کا عمومی طور پر منکر ہونا اور صحابہ کرام ؓکا اس پر خاموش نہ رہنا ثابت ہونا چاہئے۔ اگر یہ عمومی طور پر منکر نہ ہو، تو پھر اس پر صحابہ کی خاموشی کو اجماع نہیں سمجھا جاتا۔ کتاب "اسلامی شخصیت” جلد سوئم میں ہے کہ ” اجماع سکوتی یہ ہے کہ صحابہ میں سے ایک صحابی کوئی عمل انجام دیتا ہے اور صحابہ اس کے بارے میں جانتے ہیں اور اسے منع نہیں کرتے، لہذا ان کی خاموشی اجماع ہوجاتی ہے، اور اسے اجماع قولی کے بجائےاجماع سکوتی ( خاموش اجماع) کہا جاتا ہے۔ اجماع سکوتی کے لئے چند شرائط ہیں، اور وہ یہ ہیں:۔
اول: یہ کہ اسلامی حکم وہی ہے جو عام طور پر حرام سمجھا جاتا ہے اور صحابہ اس پر خاموش نہیں رہتے ۔
دوئم: یہ عمل صحابہ کرام کےدرمیان مشہور و معروف ہو۔
سوئم:یہ ان امور کے تحت آنا چاہئے جن کے بارے میں مومنین کے امیر کو اپنی رائے کے مطابق انتظام کرنے کا اختیار حاصل ہے ، جیسے خزانے سے رقم۔۔۔”
اجماع سکوتی کو بطور دلیل استعمال کرنے کے لئے ان مذکورہ بالا شرائط کا پورا ہونا لازمی ہے۔ جہاں تک "امیر المومنین” کے لقب کے معاملے پر صحابہ کے اجماع کی بات ہے، تو مذکورہ بالا شرط اجماع سکوتی سے ثابت نہیں ہوتی، بلکہ یہ اجماع قولی کی ایک شکل ہے کیونکہ صحابہ کرامؓ نے اپنی گفتگو میں اس لقب کو استعمال کیا اور انہوں نے بعد کے خلفاء کو بھی اسی طرح مخاطب کیا۔ یہ قول پر اجماع تھا نہ کہااجماع سکوتی۔ یعنی اس رائے کے مطابق اجماع کے درست اور قابلِ قبول ہونے کیلئے یہ حکم اس میں سے نہیں ہونا چاہئے جسے عام طور پر ممنوع تصور کیا جاتا ہے۔
3۔:امام کی اصطلاح کے بارے میں آپ کے سوال سے متعلق:
الف:۔ لغت میں امام کے متعدد معانی ہیں، جس میں یہ بھی شامل ہے جس کی پیروی اور تقلیدکی جائے۔ مختارالصحاح میں بیان کیا گیا ہے”لہذا امام وہ ہے جس کی تقلیدکی جائے اور اس کی جمع آئمۃ ہے”۔ کتاب العین میں بیان کیا گیا ہے "اور وہ جس کی اتباع کی جاتی ہے، اور اسے امور کا سربراہ بنایا جاتا ہے، وہ امام ہوتا ہے” اس معنی میں امام عام ہے اور یہ لقب اسے دیا جاتا ہے جس کی تقلید اور پیروی کی جاتی ہے۔
ب:۔ شریعت نے امام کی اصطلاح کو ایک فقہی اصطلاح کے طور پر استعمال کیا ہے۔ اسےعام فقہ میں مسلمانوں کے عمومی قائد کی "شرعی حقیقت” کے معنی میں استعمال کیا گیا ہے کیونکہ قانونی متن سے یہ اشارہ ملتا ہےجن میں سے کچھ یہ ہیں:۔
عبد اللہ بن عمرو بن العاص سے روایت ہے کہ انہوں نے رسول اللہ صلی اللہ علیہ وسلم کو یہ کہتے سنا: «ومن بايع إماماً فأعطاه صفقة يده، وثمرة قلبه، فليطعه…» " جو امام سے سودا کرتا ہے، اسے اپنے ہاتھ کا معاملہ اور دل کاپھل دیتا ہے، اسے چاہیے کہ پھر اس کی اطاعت کرے”۔ (مسلم)
عوف بن مالک سے روایت ہے، رسول اللہ صلی اللہ علیہ وسلم نے فرمایا:، «خيار أئمتكم الذين تحبونهم ويحبونكم، وتصلّون عليهم ويصلّون عليكم»” تمہارے سب سے اچھے حکمران وہ ہیں جن سے تم محبت کرو اور جو تم سے محبت کرتے ہیں ، جن کے لیے تم دعائیں کرو اوروہ تمہارے لیے دعائیں کریں”(مسلم)
بخاری نے ابن شہاب سے روایت کی کہ سالم نے انہیں بتایا کہ عبد اللہ ابن عمر کہتے ہیں: میں نے رسول اللہ صلی اللہ علیہ وسلم کو فرماتے سنا:، سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ: «كُلُّكُمْ رَاعٍ، وَكُلُّكُمْ مَسْئُولٌ عَنْ رَعِيَّتِهِ، الإِمَامُ رَاعٍ وَمَسْئُولٌ عَنْ رَعِيَّتِهِ "تم میں سے ہر ایک سرپرست ہے، اور اپنی رعایا کا ذمہ دار ہے، امام اپنی رعایا کا سرپرست اور ذمہ دار ہے ۔۔۔”۔
ان احادیث میں رسول اللہ صلی اللہ علیہ وسلم نے اس حکمران کے لقب کا ذکر کیا جو اسلام میں شریعت کے احکامات کو نافذ کرتا ہے، اور وہ ہے: امام ، جس طرح خلیفہ کے لقب کا ذکر دیگر شرعی نصوص میں ہوا ہے۔ یعنی شرعی نصوص نے اشارہ کیا ہے کہ "امام” کی اصطلاح "خلیفہ” کی طرح ہے اور یہ فقہی اصطلاحات میں "ایک شرعی حقیقت” ہے۔ یعنی یہ کہ قانون ساز (اللہ تعالیٰ)نے اسے متعین کیا ہے اور اس کا مطلب مسلمانوں کی عام حکمرانی ہے، اور اس کو امامتِ کبرٰٰی کہا جاتا ہے اور جو اس میں قیادت کرتا ہے اسے سب سے بڑا امام کہا جاتا ہے۔
ج- اسی طرح امام کی اصطلاح جو شریعت میں ”نماز کے امام” کے معنی کے ساتھ استعمال ہوتی ہے، جو امامت ہے، اسے امامتِ صغریٰ کہا جاتا ہے۔ اس کے بارے میں بہت سی احادیث ہیں، جن میں یہ شامل ہیں:۔
بخاری نے اپنی صحیح میں ام المومنین عائشہ رضی اللہ عنہا سے روایت کیا، انہوں نے کہا: رسول اللہ ﷺ نے بیماری کی حالت میں گھر میں نماز پڑھی، تو آپﷺ بیٹھ کر نماز پڑھ رہے تھے جبکہ (صحابہ کرامؓ) کھڑے ہوکر(ان کے پیچھے) نماز پڑھ رہے تھے۔ آپﷺنے انہیں اپنے اشارے سے بیٹھنے کی ہدایت کی، اور وہ (نماز میں) بیٹھ گئے۔ (نماز) ختم کرنے کے بعد آپﷺنے فرمایا:، «إِنَّمَا جُعِلَ الْإِمَامُ لِيُؤْتَمَّ بِهِ فَإِذَا رَكَعَ فَارْكَعُوا وَإِذَا رَفَعَ فَارْفَعُوا وَإِذَا صَلَّى جَالِساً فَصَلُّوا جُلُوساً »” امام کو اس لئے مقرر کیا گیا ہے کہ اس کی پیروی کی جائے، لہذا جب وہ رکوع کرتا ہے تو رکوع کرو، اور جب اٹھتا ہے تو اٹھو اور جب (امام) بیٹھ کر(نماز) پڑھے، تو تم ویسے ہی بیٹھ کر پڑھو"۔
سیدنا ابوہریرہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا :، «إِذَا أَمَّنَ الْإِمَامُ فَأَمِّنُوا فَإِنَّهُ مَنْ وَافَقَ تَأْمِينُهُ تَأْمِينَ الْمَلَائِكَةِ غُفِرَ لَهُ مَا تَقَدَّمَ مِنْ ذَنْبِهِ» ” جب امام آمین کہے تو آمین کہو، کیوں کہ اگر کسی فرد کی آمین فرشتوں کی آمین سے ہم آہنگ ہوجائے، تو اس کے پچھلے گناہ معاف ہوجائیں گے”۔
اصطلاح "امام” جو شریعت نے نماز کے امام کے سلسلے میں دی ہے وہ بھی ایک شرعی اصطلاح ہے جیسا کہ مذکورہ بالا احادیث سے ظاہر ہوتا ہے۔
د- نماز کے امام کے معنی میں اور خلیفہ بطور امام کے معنی میں کوئی شرعی تعلق نہیں ہے ، لہذا خلیفہ کے معنی میں جن احادیث میں امام کا ذکر کیا گیا ہے وہ لازمی طور پر نماز کے موضوع سے متعلق نہیں ہیں۔ اور وہ احادیث جن میں نماز کی امامت کے معنی میں امام کا ذکر کیا گیا ہے وہ لازمی طور پر خلیفہ اور حکمرانی سے متعلق نہیں ہیں، جیسا کہ مذکورہ بالا احادیث بھی موجود ہیں، جس سے یہ ظاہر ہوتا ہے کہ نماز میں قیادت اور حکمرانی میں قیادت یعنی خلیفہ کے درمیان کوئی قدر مشترک نہیں۔
ی- امام کی اصطلاح پر مشتمل نصوص کو ان کے سیاق و سباق میں اور قرائن (اشارے) کے مطابق سمجھنا چاہئے:
– امام کی اصطلاح شریعت کی عبارت میں لسانی معنی میں استعمال ہوسکتی ہے، جیسے اللہ نے قرآن میں فرمایا:۔
﴿وَالَّذِينَ يَقُولُونَ رَبَّنَا هَبْ لَنَا مِنْ أَزْوَاجِنَا وَذُرِّيَّاتِنَا قُرَّةَ أَعْيُنٍ وَاجْعَلْنَا لِلْمُتَّقِينَ إِمَاماً﴾
” اور وہ جو کہتے ہیں کہ ہمارے رب ہمیں ہماری بیویوں اور اولاد کی طرف سے آنکھوں کی ٹھنڈک عطا فرما اور ہمیں نیک لوگوں کا امام بنا” (الفرقان- 74)
اس آیت کے بارے میں ابن کثیر کی تفسیر میں ہے کہ ابن عباس، الحسن، قتادہ، سُدّی، اور ربیع بن انس نے کہا: ہم اچھائی میں تقلید شدہ امام ہیں۔ اور دوسروں نے کہا: یہ وہ لوگ ہیں جو اچھائی میں رہنمائی اور اس کی حمایت کرتے ہیں، اور اس تناظر سے یہ بات واضح ہوجاتی ہے کہ یہاں امام کی اصطلاح سے مرادوہ شخص ہے جو تقویٰ کی تقلید کرتا ہے،یہ حکمران کے معنی میں امام نہیں ہے یا نماز کی امامت کرنے کے معاملے میں۔
– لفظ "امام” کی اصطلاح خلیفہ کے معانی میں استعمال ہو سکتی ہے، جیسا کہ مسلم کی ابو ہریرہؓ سے روایت کردہ حدیث میں ہے کہ نبی کریم صلی اللہ علیہ وسلم نے فرمایا : «إِنَّمَا الْإِمَامُ جُنَّةٌ يُقَاتَلُ مِنْ وَرَائِهِ وَيُتَّقَى بِهِ فَإِنْ أَمَرَ بِتَقْوَى اللَّهِ عَزَّ وَجَلَّ وَعَدَلَ كَانَ لَهُ بِذَلِكَ أَجْرٌ وَإِنْ يَأْمُرْ بِغَيْرِهِ كَانَ عَلَيْهِ مِنْهُ»،"امام ان (مسلمانوں) کے لئے ایک ڈھال ہے۔ وہ اس کے پیچھےرہ کر لڑتے ہیں اور اپنا دفاع کرتے ہیں۔ اگر وہ خدا کے خوف کی یاد دلائے، جو سب سے بڑا اور عزت والا ہے، تو اس کے لئے اس کا (اجر و ثواب) بدلہ ہے۔ اور اگر وہ ایسا نہیں کرتا، تو یہ اس کے لئے بربادی ہے”۔
اس حدیث سے واضح ہے کہ اس سے مراد حکمران ہے، کیوں کہ حکمران وہ ہے جس کے پیچھے لوگ لڑتے ہیں اور وہی انصاف یا جبر کے ساتھ حکمرانی کرتا ہے اور یہاں مقصد مطلق تقلید نہیں ہے کیونکہ یہ نہ تو یہ لغوی معانی میں ہے اور نہ ہی یہ معاملہ نماز کی امامت کرنے کا ہے۔
– لفظ "امام” نماز میں امامت کے معنی میں بھی ہے جیسا کہ صحیح مسلم میں ہے، ابوہریرہؓ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: «إِذَا قَالَ الْإِمَامُ سَمِعَ اللَّهُ لِمَنْ حَمِدَهُ فَقُولُوا اللَّهُمَّ رَبَّنَا لَكَ الْحَمْدُ فَإِنَّهُ مَنْ وَافَقَ قَوْلُهُ قَوْلَ الْمَلَائِكَةِ غُفِرَ لَهُ مَا تَقَدَّمَ مِنْ ذَنْبِهِ»،” جب امام کہتا ہے، سَمِعَ اللَّهُ لِمَنْ حَمِدَهُ ، کہہ دو: اللَّهُمَّ رَبَّنَا لَكَ الْحَمْدُ ، کیونکہ اگر کوئی فرشتوں کے کہنے کے ساتھ ہم آہنگی کرتا ہے تو اس کے اپنے پچھلے گناہ معاف کردیئے جائیں گے”۔ یہاں یہ بات واضح ہے کہ سیاق و سباق نماز اور نماز کی امامت کے بارے میں ہے۔
4:۔ عبوری امیرکے بارے میں آپ کے سوال کے حوالے سے:
یہ قطعی طور پر واضح نہیں ہے کہ آپ کے اس بیان سے کیا مراد ہے،( "عارضی امیر” کے معاملے میں، کیوں معاون تنفیذ کو خلیفہ مقرر نہیں کیا گیا ہے)
جہاں تک عارضی امیر کے لئے سب سے عمر رسیدہ معاون کے انتخاب کے معاملے کی بات ہے تو ، ہم نے 31 شعبان 1435 ہجری بمطابق 31 مئی 2014 کو ایک سوال کے جواب میں اس کی وجہ واضح کردی ہے، اوراس میں مندرجہ ذیل درج ہے:
] ۔۔۔جہاں تک دوسرا معاملہ یہ ہے کہ اگر خلیفہ اپنی وفات سے قبل عبوری امیر کی تقرری نہیں کرتا، اور اس سلسلے میں ترجیحات موجود نہیں، تو یہ دراصل ایک انتظامی معاملہ ہے، اور اس انتظامی معاملے کی تفصیل پر آئینی تبنی جائز ہے اور اسی کے مطابق دفعہ 33 میں ذکر کیا گیا:
( پھر معاونین میں سے سب سے عمر رسیدہ عارضی امیر بن جاتا ہے، جب تک کہ وہ خلافت کے لئے امیدوار بننے کا ارادہ نہیں کرتا جس صورت میں اگلے سینئر معاون کو یہ منصب دیا جائے گا وغیرہ۔
ج۔ اگر تمام معاونین امیدوار بننے کا ارادہ رکھتے ہیں تو اس کے بعد معاونینِ تنفیذ میں سب سے عمر رسیدہ عارضی امیر بنے گا یا اگر وہ امیدوار بننا چاہتا ہے تو عمر میں اس سے اگلا معاون ہو گا وغیرہ۔ اگر تمام معاونینِ تنفیذ خلافت کے امیدوار بننے کا ارادہ رکھتے ہیں، تو پھر عارضی امیرکا یہ عہدہ سب سے کم عمرمعاونِ تنفیذ کو دیا جاتا ہے۔)
آپ کی معلومات کے لئے، اس کو تبنی کرنے میں معقول فکری بحث کی گئی ہے۔ معاونینِ تنفیض حکمرانی سے متعلق سب سے زیادہ علم رکھنے والے افراد اور پچھلے خلیفہ کے دور میں معاملات سے سب سے زیادہ واقف افراد ہیں۔ خلیفہ اور اس کے کام سے قربت کی بنا پر علم اور تجربہ میں ان کے بعد معاونینِ تنفیذآتے ہیں۔ عارضی قیادت سنبھالنے کے لئے یہ سب سے بہترین لوگ ہیں، اور چونکہ معاونین برابر تھے اور ان کے مابین اختیارات میں کوئی فرق نہیں تھا، اس لئے ان میں کسی ایک کو ممتاز کرنے کے لئے عمر ایک موزوں عامل ہے، جیسا کہ نماز کی امامت میں بھی، یعنی اگر نمازی نماز کی امامت کے شرائط کے لحاظ سے برابر ہوں، تب ان میں سب سے عمر رسیدہ کو ترجیح ہوگی۔
مسلم نے اپنی صحیح میں شعبہ سے، اور انہوں نے اسماعیل بن رجاء سے روایت کی کہ انہوں نے کہا: میں نے اوس بن ضمعج کو کہتے سنا، میں نے ابو مسعود کو یہ کہتے سنا کہ رسول اللہ صلی اللہ علیہ وسلم نے ہمیں بتایا: «يَؤُمُّ الْقَوْمَ أَقْرَؤُهُمْ لِكِتَابِ اللهِ، وَأَقْدَمُهُمْ قِرَاءَةً، فَإِنْ كَانَتْ قِرَاءَتُهُمْ سَوَاءً، فَلْيَؤُمَّهُمْ أَقْدَمُهُمْ هِجْرَةً، فَإِنْ كَانُوا فِي الْهِجْرَةِ سَوَاءً، فَلْيَؤُمَّهُمْ أَكْبَرُهُمْ سِنّاً، وَلَا تَؤُمَّنَّ الرَّجُلَ فِي أَهْلِهِ، وَلَا فِي سُلْطَانِهِ، وَلَا تَجْلِسْ عَلَى تَكْرِمَتِهِ فِي بَيْتِهِ إِلَّا أَنْ يَأْذَنَ لَكَ، أَوْ بِإِذْنِهِ».،” جو شخص اللہ کی کتاب کی تلاوت میں عبور رکھتا ہے، وہ نماز کی امامت کرے۔ لیکن اگر موجود سب لوگ اس میں یکساں عبور رکھتے ہیں ، تو وہ جو سنت کا سب سے زیادہ علم رکھتا ہو۔ اگر وہ اس لحاظ سے بھی برابر ہیں ، تو پھر جس نے پہلے (مدینہ منورہ) ہجرت کی ، اگر وہ اس لحاظ سے بھی برابر ہیں تو جو ان میں سب سے عمر رسیدہ ہے۔ کوئی بھی شخص نماز میں کسی اور کی امامت نہ کرے جہاں دوسرے کا اختیار ہو ، یا اس کے گھر میں اس کی اجازت کے بغیر بیٹھ جائے"۔
اسی مناسبت سے ، اس معاملے میں جو انتظامی فیصلہ اپنایا گیا تھا وہ یہ تھا کہ سب سے عمر رسیدہ معاونِ تفویض، پھر اگلا، پھر اس کے بعد سب سے عمر رسیدہ معاونِ تنفیذ، پھر اگلا اور اسی طرح آگے۔[ یہاں پچھلے سوال کے جواب سے اقتباس ختم ہوا۔
5-:خلیفہ کے ساتھ بیعت کرنے کا عہد مکمل ہونے کے بعد، خلافت کے تقرری کےمعاہدے کی کسی ایک شرط کی خلاف ورزی کے بارے میں آپ کے سوال کے سلسلے میں، جیسا کہ عدل کی شرط کی خلاف ورزی ۔۔۔، اس کا مجموعی جواب یہ ہے کہ تقرری کے معاہدے کی شرائط میں سے کسی ایک کی خلاف ورزی کا لازمی طور پر مطلب خلیفہ کی معزولی نہیں ہے۔ مثال کے طور پر عدل کی شرط کی خلاف ورزی خلیفہ کو ہٹانے کا مستحق بنا دیتی ہے، لیکن اسے فوری طور پر الگ نہیں کیا جانا چاہئے بلکہ اس کے بارے میں محکمۂ المظالم کا فیصلہ لیا جائے گا، یعنی اس کی حکمرانی کی مدت برقرار رہے گی جب تک مظالم عدالت اس معاملے پر فیصلہ نہیں دیتی۔ ہم نے اپنی کتابوں میں ایک سے زیادہ جگہ اس موضوع پر تفصیلات دیں ہیں، اور ہم نے آئین کی دفعہ 40 اور 41 میں مسودہ دستور کی جلد اول میں اس کی وضاحت کی ہے، اور آپ تفصیلات جاننے کے لئے مسودہ دستور کی کتاب سے رہنمائی لے سکتے ہیں۔
