سوال یہ ہے کہ ان دو احادیث کا آپس میں کوئی تعلق بنتا ہے یا یہ ایک دوسرے سے ٹکراتی یعنی متضاد ہیں؟
سوال:
السلام علیکم ورحمۃ اللہ وبرکاۃ
اسلامی شخصیہ جلد دوئم کے صفحہ نمبر 165 پر "شہید”کے عنوان کے تحت لکھا گیا ہے کہ "۔۔۔آخرت کے شہید کے حوالے سے مستند رائے ،جیسا کہ مسلم میں روایت کیا گیا ، وہ یہ ہے کہ ایسے شہداء پانچ ہیں: المطعون: وہ جو طاعون کی حالت میں موت کا شکار ہوا یعنی کے معلوم وبائی مرض سے موت کا شکار ہوا، المبطون: جو اسہال (ڈائیریا) کی وجہ سے موت کا شکار ہوا،الغرق: وہ شخص جو پانی میں ڈوب کر موت کے منہ میں چلا گیا، المھدوم: جو عمارت کے ملبے تلے دبنے سے موت کا شکار ہوا، اور وہ جو اللہ کے کلمے کو بلند کرنے کی جدوجہد میں میدان جنگ میں مارا گیا”۔ اس کے علاوہ ایک اور حدیث میں کہا گیا ہے کہ شہید صرف وہ ہے جو میدان جنگ میں اللہ کی راہ میں لڑتا ہو ا مارا جائے۔ جبکہ عقبہ بن عامر سے روایت ہے کہ رسول اللہﷺ نے فرمایا،
«خَمْسٌ مَنْ قُبِضَ فِي شَيْءٍ مِنْهُنَّ فَهُوَ شَهِيدٌ: الْمَقْتُولُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالْغَرِقُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالْمَبْطُونُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالْمَطْعُونُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالنُّفَسَاءُ فِي سَبِيلِ اللَّهِ شَهِيدٌ»
” پانچ حالتیں ہیں ان میں سے کسی بھی ایک حالت پر بھی مرنے والا شہید ہو گا،جو اللہ کے راستے(جہاد)میں نکلا اور قتل ہو گیا تو وہ شہید ہے، جوجہاد میں نکلا اور ڈوب کر مر گیا تو وہ شہید ہے، جوجہاد میں نکلا اور دست میں مبتلا ہو کر ہلاک ہو گیا تو وہ بھی شہید ہے، جوجہاد میں نکلا اور طاعون میں مبتلا ہو کر مر گیا وہ بھی شہید ہے، عورت(شوہر کے ساتھ جہاد میں نکلی)اورحالت نفاس میں مر گئی تو وہ بھی شہید ہے”(صحیح)۔
سوال یہ ہے کہ ان دو احادیث کا آپس میں کوئی تعلق بنتا ہے یا یہ ایک دوسرے سے ٹکراتی یعنی متضاد ہیں؟ برائے مہربانی اس معاملے کی وضاحت فرمادیں۔
دوسرا سوال:
اسی شہید کے مضمون میں یہ بتایا گیا ہے کہ عبداللہ بن عمرو بن العاص ؓنے روایت کی کہ رسول اللہﷺ نے فرمایا، »
«يُغْفَرُ لِلشَّهِيدِ كُلُّ ذَنْبٍ إِلَّا الدَّيْنَ»
"شہید کے تمام گناہ معاف ہوجاتے ہیں سوائے قرض کے”۔
سوال یہ ہے کہ اگر شہید اپنی شہادت کے بعد اپنا قرض واپس نہیں کرپاتا تو پھر کس کو اس کی شہادت کے بعد اس کا قرض واپس کرنا چاہیے؟ پیشگی شکریہ ۔
جواب:
وعلیکم السلام و رحمۃ اللہ و برکاۃ
پہلےشہدا کے حوالے سے:
1۔ مسلم نے ابو ہریرہؓ سے روایت کی ہے کہ رسول اللہﷺ نے فرمایا،
«بَيْنَمَا رَجُلٌ يَمْشِي بِطَرِيقٍ وَجَدَ غُصْنَ شَوْكٍ عَلَى الطَّرِيقِ فَأَخَّرَهُ فَشَكَرَ اللَّهُ لَهُ فَغَفَرَ لَهُ وَقَالَ الشُّهَدَاءُ خَمْسَةٌ الْمَطْعُونُ وَالْمَبْطُونُ وَالْغَرِقُ وَصَاحِبُ الْهَدْمِ وَالشَّهِيدُ فِي سَبِيلِ اللَّهِ عَزَّ وَجَلَّ»
” ایک شخص جا رہا تھا، اس نے راہ میں ایک کانٹے کی ڈالی دیکھی، اس نےوہ ہٹا دی، اللہ تعالیٰ نے اس کا بدلہ دیا اور اس کو بخش دیا۔ اور آپ ﷺنے فرمایا:شہید پانچ ہیں جو طاعون(وبا یعنی جو مرض تیزی سے پھیل جائے)سے مرے، جو پیٹ کے عارضے سے مرے(جیسے اسہال یا پیچش یا استسقا سے)،جو پانی میں ڈوب کر مرے، جو دَب کر مرے، جو اللہ کی راہ میں (یعنی جہاد کرتا ہوا)مارا جائے”۔
2۔ عقبہ بن عامر سے روایت ہے کہ رسول اللہﷺ نے فرمایا،«
«خَمْسٌ مَنْ قُبِضَ فِي شَيْءٍ مِنْهُنَّ فَهُوَ شَهِيدٌ: الْمَقْتُولُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالْغَرِيقُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالْمَبْطُونُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالْمَطْعُونُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالنُّفَسَاءُ فِي سَبِيلِ اللَّهِ شَهِيدٌ»
"پانچ حالتیں ہیں کہ ان میں سے کسی بھی ایک حالت پر مرنے والا شہید ہو گا، جواللہ کے راستے(جہاد)میں نکلا اور قتل ہو گیا تو وہ شہید ہے، جہاد میں نکلا اور ڈوب کر مر گیا تو وہ شہید ہے، جہاد میں نکلا اور دست میں مبتلا ہو کر ہلاک ہو گیا تو وہ بھی شہید ہے، جہاد میں نکلا اور طاعون میں مبتلا ہو کر مر گیا وہ بھی شہید ہے،وہ عورت جو جہاد میں نکلی اورحالت نفاس میں مر گئی تو وہ بھی شہید ہے”(النسائی /الطبرانی)۔
3۔ ان میں کوئی ٹکراؤنہیں ہے۔ مسلم کی حدیث مطلق ہے:
«الْمَطْعُونُ وَالْمَبْطُونُ وَالْغَرِقُ وَصَاحِبُ الْهَدْمِ»
” جو طاعون ، پیٹ کے عارضے ، پانی میں ڈوب کر ، جو دب کر”۔
جہاں تک اس حدیث کا تعلق ہے تو یہ ان الفاظ کے ساتھ مقید ہے،"اللہ کی راہ میں”،
«وَالْغَرِيقُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالْمَبْطُونُ فِي سَبِيلِ اللَّهِ شَهِيدٌ، وَالْمَطْعُونُ فِي سَبِيلِ اللَّهِ شَهِيدٌ»
” جہاد میں نکلا اور ڈوب کر مر گیا تو وہ شہید ہے، جہاد میں نکلا اور دست میں مبتلا ہو کر ہلاک ہو گیا تو وہ بھی شہید ہے، جہاد میں نکلا اور طاعون میں مبتلا ہو کر مر گیا وہ بھی شہید ہے۔ "
لہٰذا دونوں احادیث کو جوڑا جائے گا اور مطلق کو مقیدکے مطابق لیا جائے گا، پس تمام لوگ شہید ہیں اگروہ اللہ کی راہ میں مارے جائیں، اور "اللہ کی راہ میں” کے الفاظ ان کی حد بندی کرتے ہیں۔ چنانچہ اگر ‘اللہ کی راہ میں’ کے الفاظ کو مال خرچ کرنے سے جوڑا گیا ہو جیسا کہ "ینفقون فی سبیل اللہ” یا ‘اللہ کی راہ میں’ کے الفاظ کا ذکر جہاد کے ساتھ کیا گیا ہو جیسا کہ "یجاھدون فی سبیل اللہ” تو اس کا معنی ہے ایسا قتال جو اللہ کے کلمہ کو بلند کرنے کے لیے کیا جائے۔ جیسا کہ صحیح بخاری میں ذکر کیا گیا کہ ابو موسی ؓ نے فرمایا: ایک آدمی رسول اللہﷺ کے پاس آیا اور کہا: اے اللہ کے رسولﷺ وہ شخص جو مال غنیمت کے لیے لڑتا ہے اور ایک شخص جو لڑتا ہے تا کہ اس کا رتبہ بلند ہو، تو ان میں سے کون ہے جس نے اللہ کی راہ میں لڑائی کی؟ رسول اللہﷺ نے فرمایا: »
«مَنْ قَاتَلَ لِتَكُونَ كَلِمَةُ اللَّهِ هِيَ الْعُلْيَا فَهُوَ فِي سَبِيلِ اللَّهِ»
"وہ جو لڑتا ہے تا کہ اللہ کا کلمہ بلند ہو، اللہ کی راہ میں لڑنے والا وہی شخص ہے”۔۔۔۔
اگر الفاظ "اللہ کی راہ میں(فی سبیل اللہ)” کا ذکر بغیر کسی قرینہ کے کیا جائے کہ جو اس کے معنی کی تحدید کرتے ہوں تو یہ اللہ کی اطاعت اور تقرب پر دلالت کرتے ہیں ۔ پس جو شخص اللہ کی اطاعت کرنےوالا ہو اوراس طرح مرےجیسا کہ حدیث میں مذکور ہے تو وہ آخرت کا شہید(شہید آخرۃ) ہے جب کہ اللہ کی راہ میں مارا جانے والا دنیا اور آخرت دونوں کا شہید ہے۔ یعنی مبطون یا مطعون یا غرق ہونے والا۔۔۔مر جائے اور اللہ کا اطاعت گزار ہو تو یہ شہداء ہیں ۔ اگر وہ ان پانچ میں سے نہ ہو اور وہ اللہ کے اطاعت گزار ہو اور مر جائے تو اُس پر اِس حدیث کا اطلاق نہیں ہو گا۔
دوسری بات:
جہاں تک آپ کے اس سوال کا تعلق ہے کہ کون شہید کے قرض کو ادا کرے گا تواگر وہ اپنی موت سے پہلے اسے ادا نہیں کرپاتا، تو اس کا قرض اتارنے کی ذمہ داری اس کی ورثاء پر عائد ہوتی ہے۔ اگر ورثاء یہ قرض اتارنے کے قابل نہ ہوں تو پھر ریاست اس کا قرض ادا کرتی ہے جیسا کہ رسول اللہ ﷺ کی حدیث میں بتایا گیا: «
«أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ، مَنْ تَرَكَ مَالاً فَلِأَهْلِهِ، وَمَنْ تَرَكَ دَيْناً أَوْ ضَيَاعاً فَإِلَيَّ وَعَلَيَّ»
"میں ہر مومن سے اس کی جان سے زیادہ قریب تر ہوں پس جو کوئی قرض دار مر جائے تو اس کی ادائیگی میرے ذمہ ہو گی اور جو کوئی مال چھوڑ کر مرے تو وہ اس کے ورثاء کا ہو گا "(مسلم)۔
اس کے علاوہ رسول اللہ ﷺ کی حدیث جسے ابو داؤد نے روایت کیا کہ جابرؓ نے کہا:
«كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم لَا يُصَلِّي عَلَى رَجُلٍ مَاتَ وَعَلَيْهِ دَيْنٌ، فَأُتِيَ بِمَيِّتٍ فَقَالَ: أَعَلَيْهِ دَيْنٌ؟ قَالُوا: نَعَمْ دِينَارَانِ. قَالَ: صَلُّوا عَلَى صَاحِبِكُمْ. فَقَالَ أَبُو قَتَادَةَ الْأَنْصَارِيُّ: هُمَا عَلَيَّ يَا رَسُولَ اللَّه،ِ قَالَ: فَصَلَّى عَلَيْهِ رَسُولُ اللَّهِ صلى الله عليه وسلم، فَلَمَّا فَتَحَ اللَّهُ عَلَى رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ: أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ. فَمَنْ تَرَكَ دَيْنًا فَعَلَيَّ قَضَاؤُهُ، وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ»
"رسول اللہ ﷺ اُس شخص کی نماز جنازہ نہیں پڑھتے تھے جو اس حال میں مرتا کہ اس پر قرض ہوتا، چنانچہ آپ ﷺکے پاس ایک جنازہ لایا گیا، آپﷺ نے پوچھا: ”کیا اس پر قرض ہے؟“لوگوں نے کہا: ہاں، اس کے ذمہ دو دینار ہیں، آپﷺ نے فرمایا: ”تم اپنے ساتھی کی نماز پڑھ لو“، تو ابوقتادہ انصاری ؓ نے کہا: میں ان کی ادائیگی کی ذمہ داری لیتا ہوں اے اللہ کے رسول! ۔ تو رسول اللہﷺ نے اس کی نماز جنازہ پڑھی، پھر جب اللہ نے اپنے رسولﷺ کو فتوحات اور اموالِ غنیمت سے نوازا تو آپ ﷺ نے فرمایا: ”میں ہر مومن سے اس کی جان سے زیادہ قریب تر ہوں پس جو کوئی قرض دار مر جائے تو اس کی ادائیگی میرے ذمہ ہو گی اور جو کوئی مال چھوڑ کر مرے تو وہ اس کے ورثاء کا ہو گا۔”
میں امید کرتا ہو کہ آپ کے دونوں سوالات کا تشفی جواب دیا گیا ہے، اور اللہ سبحانہ و تعالیٰ بہتر جانتے ہیں اور وہی سب سے زیادہ عقل و حکمت والے ہیں ۔
