اس وبا کا مصدر کیا ہے؟ عالمی معیشت پر اس کا عملاً کیا اثر ہوگا؟ اس کا درست علاج کیا ہے؟ کیا اس مرض کے سبب جمعہ اور جماعت کی نماز روکنا درست ہے؟

سوال:
چین نے 4 جنوری 2020 ءکو پہلی بار خاص طور پر ووھان شہر میں دسیوں افراد کے کرونا کے مرض میں مبتلا ہونے کا اعلان کیا اور اس کو covid-19کا نام دیا پھر یہ مرض تقریبا ساری دنیا میں پھیل گیا ،بہت سے ممالک نے اپنی سرحدیں بند کردیں اور نقل وحرکت پر پابندی لگادی، اس کے بعد جمعہ اور جماعت کی نمازیں بھی روک دی گئیں، اس مرض نے عالمی معیشت پر کاری ضرب لگائی ،امریکہ اور چین نے ایک دوسرے پر الزامات لگانا شروع کر دیے ۔۔۔اس وبا کا مصدر کیا ہے؟ عالمی معیشت پر اس کا عملاً کیا اثر ہوگا؟ اس کا درست علاج کیا ہے؟ کیا اس مرض کے سبب جمعہ اور جماعت کی نماز روکنا درست ہے؟
جواب:
کرونا وائرس کو انگریزی میں Crownکا نام دیاگیا عربی میں اس کےمعنی تاج کے ہیں کیونکہ مائیکروسکوپ میں اس کی شکل تاج کی طرح کی ہوتی ہے۔ 1960ء میں پہلی بار Viridi کرونا کا انکشاف ہوا تھا، اسی وائرس کے خاندان سے 2003 میں چین کے علاقے ہانگ کانگ میں ایک وائرس کا انکشاف ہوا جس کو سارس کا نام دیا گیا ،جس سے 8422 افراد متاثر ہوئے جن میں سے 916 اموات ہوئیں ۔ 2004ءاور 2005 ءمیں اس کی نئی اقسام منظر عام پر آئیں، یوں یہ تسلسل سے سامنے آتا رہا خاص کر 2012 ءمیں اور 2014 ءمیں مگر یہ محدود علاقوں میں محدود پیمانے پر تھا۔ دسمبر2019 میں چین کے شہر ووھان میں یہ ایک بار پھر سامنے آیا ہے ،حالیہ وائرس سارس 2وائرس سے96٪مشابہ ہے اس لیے اس کو 2019 میں کرونا وائرس کا نام دیاگیا مختصر طور پر اس کوCovid19 کہاجاتاہے جوکہ 2019 ءمیں اس کے ظہور کی طرف اشارہ ہے ۔پہلی بار اس کا شکار ہونے والوں کے تانے بانے ووھان شہر کی سمندری اور جنگلی حیات کی فوڈ مارکیٹ سے ملے، یہاں سے ہی یہ کئی ملحقہ علاقوں میں پھیل گیا ۔پھر اس کے چمگادڑکے تاج والے وائرس سے96٪ مشابہت بھی سامنے آگئی جس کی وجہ سے اس کو اصولی طور پر چمگادڑ سے منسوب کیاگیا۔ اس بار اس سے ہلاکتوں کی تعداد میں اضافہ ہوگیا جن میں سے بیشتر کاتعلق چین سے تھا،جہاں 81193 افراد اسے متاثر ہوئے جن میں سے3ہزار ہلاک ہوئے، اس کے بعد اٹلی، ایران، اسپین، فرانس اور امریکہ… میں اس کے پھیلنے سے دنیا کے ہرگوشے میں خوف وہراس پھیل گیا یہاں تک کہ24مارچ 2020 ءتک400400افراد کے اس سے متاثر ہونے کی تصدیق ہوچکی ہے اور تقریبا 20ہزار افراد اس سے مرچکے ہیں(Deutsche Willi 25/3/2020) اقوام متحدہ کے سربراہ António Guterresنے کہا کہ Covid-19 کو پھیلنے سے نہ روکا گیا تو کئی ملین لوگ مرجائیں گے( ایرو نیوز- 19مارچ 2020)… اسی لیے کئی ممالک نے سکو ل یونیورسٹیوں کو بند کردیا اور اجتماعات پر پابندی لگا دی، لاک ڈاؤن اور اجتماعی قرنطینہ کا اعلان کیا حتی کہ جمعہ اور جماعت کی نماز معطل کرنے کا اعلان کیا…. اس سے پیدا ہونے والے مندرجہ ذیل امور کی وضاحت ضروری ہے:
اول : کیا اس مرض کے پس پردہ کوئی ہے جس نے اس کو بناکر پھیلایا یا یہ بھی دوسرے امراض کی طرح اللہ کا فیصلہ اور انسانوں کے اعمال کا نتیجہ ہے؟
دوم : کیا سرمایہ دارانہ دنیا نے اس مسئلے کا درست حل دیا؟ اس جیسے حالات کا شرعی حل کیا ہے؟
سوم : تیل کی قیمتوں اور عالمی معیشت پر اس کرونا وبا کا کیا اثر ہوگا؟
چہارم : کیا اس مرض کے سبب جمعہ اور جماعت کی نماز ترک کرنا جائز ہے؟
اول : اس مرض کی ابتدا اور اس کے پس پردہ محرکات:
1) کرونا Covid-19 کا پھیلاؤ چین سے شروع ہوا، سائنسی اور طبی تحقیق کہتی ہے کہ یہ جانوروں سے انسانوں کو منتقل ہوا ،اور ہم یہ دیکھتے ہیں کہ چین کے کفار عام طور پر ہر قسم کے جانوروں کو کھاتے ہیں وہ پاک اور ناپاک میں فرق نہیں کرتے…جیسا کہ ہم نے پہلے کہا کہ میڈیا رپورٹس کے مطابق چین کا شہر ووھان اس قسم کے خبیث گوشت کا تجارتی مرکز ہے، اور یہی شہر اس بیماری منبع ہے۔
یوں کرونا چین میں پھیلا ،پھر ایران میں ان چینی مزدوروں کے ذریعے منتقل ہوا جو قم شہر میں ریلوے ٹریک تعمیر کرنے والی چینی کمپنی میں کام کر رہے تھے… پھر ایران سے ہی کرونا پورے مشرق وسطیٰ میں پھیل گیا۔ اسی طرح اٹلی نے بھی چینی سرمایہ کاری سے نقل و حمل کے انفراسٹرکچر کے منصوبوں کو شروع کیا تھا…. رپورٹس کے مطابق لومباڈی اور ٹوسکانا کے علاقے میں ہی سب سے زیادہ چینی سرمایہ کاری ہوئی ہے اور لومبارڈی کے علاقے میں ہی 21 فروری کو کرونا کا پہلا کیس سامنے آیا اور یہی علاقہ سب سے زیادہ متاثر ہے…
2) چین کی طرف سے کرونا سے نمٹنے میں کوتاہی اورابتدا میں اس کو چھپانے اور اس پر قابو پانے میں ناکامی پر امریکہ چین پر برس پڑا جس پر چینی وزارت خارجہ کے ترجمان”ژاو گیان” نے سخت ردعمل کا اظہارکرتے ہوئے13مارچ 2020 ءکوٹویٹ کیا کہ :”اس بات کا امکان ہے کہ امریکی فوج کرونا وائرس ووھان میں لائی "…. (الشرق الاوسط 13مارچ 2020) ۔امریکی صدر نے بھی چین پر وار کرتے ہوئے کہا:”چین کی جانب سے نئے کرونا کے حوالے سے معلومات فراہم نہ کرنے کی دنیا کو بھاری قیمت ادا کرنی پڑے گی”…. (ایرو نیوز 19/3/2020)….. 16مارچ 2020 کو امریکی صدر نے اپنے ٹویٹ میں کرونا کو چینی وائرس قرار دیتے ہوئے کہا:”امریکہ چینی وائرس سے متاثرہ شعبوں جیسے ہوا بازی کو بھاری امداد دے گا”۔ چینی وزارت خارجہ نے17مارچ 2020 کو اس کا جواب دیتے ہوئے کہا:” یہ بات چین کو بدنام کر رہی ہے ہم اس پر سخت ناراض ہیں اور اسے سختی سے مسترد کرتے ہیں”… (رشیا ٹُو ڈے 18/3/2020) ۔جب شروع میں چین نے یہ الزام لگایا کہ وائرس کو پھیلانے میں امریکہ کا ہاتھ ہے تو واشنگٹن نے13مارچ 2020 کو چینی سفیر کو طلب کیا اور امریکی دفتر خارجہ کے عہدیدار نے کہا:” سازشی نظریات کو پھیلانا سخت خطرناک اور گِرا ہوا کام ہے ہم چینی حکومت کو تنبیہ کرتے ہیں کہ اس کو معاف نہیں کریں گے۔ چینی قوم اور دنیا کا مفاد اس میں ہے کہ چین وبا کے پھیلنے میں اپنے کردار کی تلافی کرے” پھر شینگونیوز ایجنسی نے یہ زور دیتے ہوئے کہا کہ بیجنگ کے اقدامات اورکئی ملین افراد کے قرنطینہ سے دنیا کو” قیمتی وقت”مل گیا جس کا عالمی برادری بھی اعتراف کررہی ہے(رشیا ٹو ڈے 15/3/2020)۔
3)یوں کرونا وائرس Sars Cov2 یعنی Covid19کے پھیلنے پر امریکہ اور چین کے درمیان لفظی جنگ شروع ہوگئی ۔دونوں ایک دوسرے پر اس وبا کو پھیلانے کے براہِ راست ذمہ دار ہونے کا الزام لگارہے ہیں اگرچہ دونوں حکومتوں کا اس کے پھیلاؤ کے پیچھے ہاتھ ہونا بعید از امکان نہیں تاہم اس حوالے سے چھان بین کے بعداس وبا کو پھیلانے کے پیچھے امریکہ یا چین کے ہاتھ ہونے اور اس کو دوسرے ملکوں میں منتقل کرنے کی کوئی ٹھوس دلیل نہیں، اس کے دونمایاں اسباب ہیں:
پہلا: یہ دونوں ملک خود اس مرض میں گردن تک ڈوب گئے ہیں ،تادم تحریر اعداد وشمار کے مطابق چین میں کرونا سے متاثرین کی تعداد 81272 اور مرنے والوں کی تعداد3273ہے جیسا کہ چائنا نیشنل ہیلتھ کمیٹی نے23مارچ 2020 کوکہا: اگروہ اس کو پھیلانے کے ذمہ دار ہوتے تو کم از کم اپنے آپ کو بچالیتے۔
جبکہ CNN Health کےمطابق امریکہ میں کرونا سے مرنے والوں کی تعداد 704اور متاثرین کی تعداد تادم تحریر52976ہے (سی این این عربی 25مارچ 2020)۔ چین اور اٹلی کے بعد کرونا سے متاثر ملکوں میں امریکہ تیسرے نمبر پر ہے… تازہ ترین اقدامات کے مطابق سات ریاستوں میں ایک تہائی امریکیوں کو گھروں سے باہر نہ نکلنے کے احکامات دئیے گئے ہیں نیویارک، کونیٹیکٹ اور نیوجرسی کے بعدلویزیانا اور اوہائیو نے بھی نقل و حرکت پر پابندی لگادی ہے(الجزیرۃ 23مارچ 2020) ۔پس اگر اس مرض کو پھیلانے کے پیچھے امریکہ ہوتا توکم از کم اپنے آپ کو بچالیتا۔
دوسرا: ان دونوں ممالک میں سے کسی ایک کی جانب سے اس وائرس کو بنانے کی بات اس لیے بھی درست نہیں کہ ابھی تک کوئی ایسی دلیل نہیں کہ یہ وائرس لیبارٹری میں بنایاگیا ہے چنانچہ Nature Medicine میگزین کے مطابق "پہلے سے معلوم کرونا وائرسوں کی اقسام کے جینیاتی مادے کی ترتیب کے حالیہ کرونا وائرس کے ساتھ تقابل سے یہ بات مضبوطی سے ثابت ہو تی ہے کہ یہ کرونا وائرس فطری عمل کے نتیجے میں بناہے” میگزین نے یہ بھی کہا ہے کہ”اس بات کی تائید وائرس کے بنیادی ڈھانچے اور مالیکیولر سٹرکچر کے متعلق معلومات سے بھی ہوتی ہے ۔لیبارٹری میں بنائے گئے وائرس کو اس کے بنیادی ڈھانچے سے پہچانا جاسکتاہے"https://www.npr.org۔ یہی بات روس ،یورپ، ایران سمیت عالم اسلام میں قائم تمام ریاستوں کے متعلق بھی ہے، یہ سب بیماری کے منتقل ہونے میں چین یا امریکہ میں سے کسی ایک سے متا ثر ہوئے۔
اس لیے اللہ کے اس ارشاد کے علاوہ کوئی بات نہیں کہ: ﴿ظَهَرَ الْفَسَادُ فِي الْبَرِّ وَالْبَحْرِ بِمَا كَسَبَتْ أَيْدِي النَّاسِ لِيُذِيقَهُمْ بَعْضَ الَّذِي عَمِلُوا لَعَلَّهُمْ يَرْجِعُونَ﴾ "لوگوں کے اعمال کے سبب بحروبر میں فساد برپا ہوگیاہے تاکہ ان کے بعض اعمال کا مزہ ان کو چکھادے شاید وہ باز آئیں"۔ یہ بات تو ہم سب کو معلوم ہے کہ سرمایہ دار وں اور ان کے پیروکاروں نے اس دنیا کو شروفساد کی آماجگاہ بنادیاہے ۔ یہ اپنے مفادات اور ہوس کے علاوہ کسی چیز کو اہمیت نہیں دیتے… امریکہ، چین، روس، یورپ …کے حکمران ہی اس دنیا کی بدبختی اور اقوام کی مصائب کا سبب ہیں، انسانیت کے خلاف ان کے جرائم کی تعداد بہت زیادہ ہے۔ انہوں نے ہی نہتے انسانوں پر ایٹم بم، افزودہ یورینیم اور جلانے والے نیپام بم گرائے، افریقہ کے قبائل کو وحشیانہ طریقے سے غلام بنایا، ان کو اپنے بائیولاجیکل اور کیمیکل ہتھیاروں کے تجربات کے لیے تختۂ مشق بنایا، ریڈ انڈینز کی نسل کشی کی جنگ ان کی پیشانی پر رسوائی کا داغ ہے، ایغور مسلمانوں پر چین کے جرائم نے زمین و آسمان کو بھر دیا، روس اور سربوں کے وسطی ایشیا اور بلقان میں جرائم اور شام میں ان کے ہولناک جرائم ابھی جاری ہیں، برصغیر کے مسلمانوں اور غیر مسلموں پر برطانوی جرائم کے اثرات آج بھی ہیں، یہ جرائم اس بات کی تائید کرتے ہیں کہ اقوامِ عالم پر حکمرانی کرنے والے یہ ممالک انسانیت کی بدبختی کا سبب ہیں جیسا کہ اللہ طاقتور غالب ان کے بارے میں فرماتاہے: ﴿فَأَصَابَهُمْ سَيِّئَاتُ مَا كَسَبُوا وَالَّذِينَ ظَلَمُوا مِنْ هَؤُلَاءِ سَيُصِيبُهُمْ سَيِّئَاتُ مَا كَسَبُوا وَمَا هُمْ بِمُعْجِزِينَ﴾ "وہ اپنے اعمال کے وبال سے دوچار ہوئے اور جو لوگ ان میں سے ظلم کرتے رہے ہیں کو عنقریب اپنے اعمال کے وبال کا سامنا ہوگا اور یہ (اللہ کو )عاجز کرنے والے نہیں"۔
دوم: سرمایہ داروں اور ان کے پیروکاروں کی جانب سے اس مسئلے کے حل میں غلطی اور اس کا درست شرعی حل:
سرمایہ داروں اور ان کے پیروکاروں نے اس مسئلے کو تین مراحل میں حل کرنے کی کوشش کی
**پہلا مرحلہ: اس معاملے کا بلیک آوٹ
1) چینی رپورٹ میں انکشاف کیا گیا کہ چینی حکومت نے چینی عوام اور دنیا سے اس قاتل مرض کی حقیقت کو چھپایا۔چینی حکومت دسمبر2019 کے وسط سے ہی اس کے پھیلاؤسے باخبر تھی مگر اس نے اس بارے میں خاموشی اختیار کی اور سال کے آخر میں اس کے شکار افراد کی تعداد بڑھنے تک اس کا اعتراف نہیں کیا۔ چینی-امریکی صحافی "شانگ وی وانگ” نے کہا کہ حکومت نے جنوری تک ووھان کی سمندری فوڈمارکیٹ کو بھی بند نہیں کیا جہاں سے یہ مرض پھیل گیاتھا۔
رپورٹ میں اس بات کا بھی انکشاف کیا گیا کہ بحران کی ابتدا میں اس مرض کے بارے میں معلومات کاتبادلہ کرنے پر 8 چینی باشندوں کو غیر مصدقہ معلومات فراہم کرکے قانون شکنی کا مرتکب قرار دے کر گرفتار کیاگیا، رپورٹ میں مزید کہا گیا کہ ووھان میں مقامی اتھارٹیز کہہ رہی ہیں کہ حالات معمول پر ہیں اور 18 جنوری کو ایک روایتی مقامی تہوار کی بھی اجازت دی گئی جس میں تقریبا40ہزار خاندانوں نے شرکت کی(حوالہ سابقہ 1/2/2020)۔
2) چینی عہدہ داروں نے 31 دسمبرتک اس بحران کے خطرات کو عوام سے پوشیدہ رکھا، تب چین نے عالمی ادارہ صحت کو اطلاع دیتے ہوئے کہا کہ "مرض سے بچاؤ اور اس پر قابو پانا ممکن ہے”۔ 23 جنوری کو چینی حکومت نے ووھان شہر میں لاک ڈاؤن کیا اور سفر پر مکمل پابندی لگا دی(مصراوی 23/3/2020)…
**دوسرا مرحلہ :قرنطینہ اور جزوی طور پر الگ تھلگ کرنا…
1) امریکی محکمہ صحت کے عہدہ دار نے ہفتے کے دن کہا کہ آٹھواں شخص نئے کرونا وائرس کا شکار ہوگیاہے، امریکی وزارتِ دفاع نے کہا کہ باہر سے آنے والے جن لوگوں کو قرنطینہ میں رکھنا ہوا انہیں پناہ گاہیں فراہم کریں گے…… چین کے وسط میں ووھان اور ھوبی جہاں وائرس منظرعام پر آیا عملی طور پر قرنطینہ میں ہیں(سکائی نیوز 2/2/2020)
2) امریکہ میں نیویارک کے گورنر اندروکومو نے کہا کہ "ہم قرنطینہ میں ہیں” اورتاکیداً کہا "ہوسکتا ہے کہ ہم اس سے زیادہ سخت اقدامات اٹھائیں ” نیویارک، کیلیفورنیا اور نیوجرسی کے بعدIllinoisمیں لاک ڈاؤن کی حالت میں 85 ملین افراد گھروں تک محدود ہیں، جن کو صرف محدود چہل قدمی اور شاپنگ کا استثنیٰ ہے…… (Deutsche Willi-21مارچ 2020)
***گھروں میں قریباً مکمل علیحدگی….
دنیا میں سینکڑوں ملین اشخاص اس امید سے گھروں میں روکے گئے ہیں کہ شاید کرونا وبا کے پھیلاؤ کو روکنا ممکن ہو جس کی وجہ سے گیارہ ہزار لوگ مرچکے۔ انسانی تاریخ میں کبھی اس قسم کے سخت اقدامات نہیں اٹھائے گئےجو اس وقت مختلف ممالک میں مختلف انداز سے اٹھائے گئے ہیں … 800 ملین سے زیادہ لوگ 30 سے زیادہ ممالک میں گھروں میں محبوس ہیں خواہ یہ عام حفاظتی اقدامات کی وجہ سے ہو یا گھومنے پھرنے پر پابندی کی وجہ سے(فرانس پریس)…. جرمنی میں حکومت نے حفاظتی اقدامات کو مزید سخت کرنے اور زندگی کو مقید کرکے بیشتر لوگوں کو گھروں میں بند کرنے کا فیصلہ کیا ہے…. اٹلی جو یورپ میں سب سے زیادہ متاثر ہوا جہاں 4ہزار لوگ مرچکے ہیں، بوڑھے براعظم میں پہلا ملک ہے جس نے اپنے شہریوں کو گھروں میں محبوس کردیا تاکہ کرونا وبا کے پھیلاؤکے روک تھام سے متعلق اقدامات کو مزید سخت کیا جاسکے ،اب ہفتے کے آخری دنوں کی چھٹیوں میں تمام پارکس اور سیرگاہوں کو بند کرکے اٹلی اپنے لوگوں کوان کے گھروں میں قید کرنے کے اقدامات کر رہاہے، چوبیس گھنٹے کے اندر627 افراد کے ہلاک ہونے اور بحران کے انتہا پر پہنچنے کے بعدحکومت نے یہ اقدامات کیے ہیں(Deutsche Willi 21/3/2020)
ان تینوں حل پرغورکرنے سے معلوم ہوتاہے یہ مسئلے کو حل نہیں کرتے بلکہ یہ معاشی ناکامی میں مزید اضافہ کرکے ایک اور ناکامی کا سبب بنتے ہیں جس سے یہ مرض بھی دوچند ہوگا اور لوگ مزید بیماریوں کا شکار بھی ہوں گے جیسا کہ ہم سرمایہ دارانہ معاشرے کے حالات کے بارے میں سُن رہے ہیں… اس لیے اس مرض کادرست علاج وہی ہے جو اللہ کی شریعت میں آیا ہے کہ ریاست ابتدا میں ہی اس مرض کا پیچھا کرتی ہے اور مرض کو اسی جگہ تک محدود رکھنے کے لیے کام کرتی ہے جہاں وہ پیدا ہوا ہو ،اور دوسرے علاقوں میں تندرست لوگ کام اور پیداوار کوبڑھانے کو جاری رکھیں…. بخاری نے اپنے صحیح میں اُسامہ بن زید سے نبی کریم صلی اللہ علیہ وسلم کا ارشاد نقل کیا ہے کہ«إِذَا سَمِعْتُمْ بِالطَّاعُونِ بِأَرْضٍ فَلَا تَدْخُلُوهَا وَإِذَا وَقَعَ بِأَرْضٍ وَأَنْتُمْ بِهَا فَلَا تَخْرُجُوا مِنْهَا»”جب تم کسی زمین میں طاعون کے بارے میں سنو تو وہاں مت جاؤ اور اگر وہ کسی ایسی زمین میں پھیل جائے جہاں تم ہو تو وہاں سے مت نکلو” بخاری اور مسلم میں ایک اور حدیث ہے ،مسلم کے الفاظ ہیں کہ اُسامہ بن زید نے رسول اللہ صلی اللہ علیہ وسلم سے روایت کیا ہے کہالطَّاعُونُ رِجْزٌ أَوْ عَذَابٌ أُرْسِلَ عَلَى بَنِي إِسْرَائِيلَ أَوْ عَلَى مَنْ كَانَ قَبْلَكُمْ فَإِذَا سَمِعْتُمْ بِهِ بِأَرْضٍ فَلَا تَقْدَمُوا عَلَيْهِ وَإِذَا وَقَعَ بِأَرْضٍ وَأَنْتُمْ بِهَا فَلَا تَخْرُجُوا فِرَاراً مِنْهُ»”طاعون ایک عذاب ہے جسے بنی اسرائیل یاتم سے پہلے لوگوں پر نازل کیا گیا، اگر تم کسی زمین میں اس کے پھیلنے کا سنو تو وہاں مت جاؤ اور اگروہ کسی ایسی زمین میں پھیل جائے جہاں تم ہو،تو وہاں سے مت نکلو” بخاری میں عائشہ رضی اللہ عنھاسے روایت ہے کہسَأَلْتُ رَسُولَ اللَّهِ ﷺعَنْ الطَّاعُونِ فَأَخْبَرَنِي «أَنَّهُ عَذَابٌ يَبْعَثُهُ اللَّهُ عَلَى مَنْ يَشَاءُ وَأَنَّ اللَّهَ جَعَلَهُ رَحْمَةً لِلْمُؤْمِنِينَ لَيْسَ مِنْ أَحَدٍ يَقَعُ الطَّاعُونُ فَيَمْكُثُ فِي بَلَدِهِ صَابِراً مُحْتَسِباً يَعْلَمُ أَنَّهُ لَا يُصِيبُهُ إِلَّا مَا كَتَبَ اللَّهُ لَهُ إِلَّا كَانَ لَهُ مِثْلُ أَجْرِ شَهِيدٍ "رسول اللہ صلی اللہ علیہ وسلم سے طاعون کے بارے میں سوال کیاگیا تو آپ نے مجھے بتایا کہ یہ اللہ کا عذاب ہے جس پر اللہ چاہتاہے اس کو نازل کرتاہے مگر اللہ نے مومنوں کے لیے اس کو رحمت بنایا ہے اور جو بھی کسی ایسی زمین میں ہو جہاں یہ پھیل جائے اور وہ صبر کے ساتھ ثواب کی نیت سے یہ جانتے ہوئے وہاں ٹھہرارہے کہ اس کے ساتھ وہی ہوگا جو اللہ نے لکھا ہے، تو اسے شہید کا اجر ملے گا"۔
اس قسم کا قرنطینہ اس ریاست میں تھا کہ جو تمام ریاستوں میں سب سے آگے تھی اور جس کی تہذیب سب سے اعلیٰ تھی، جس کے سربراہ رسول اللہ ﷺ کی عطا کردہ وحی کے ذریعےحکمرانی کررہے تھے۔ ابنِ حجر نے فتح الباری میں ذکرکیا ہے کہ عمر ؓبن خطاب شام کے سفر کےلیے نکلے ،جب سرغ میں پہنچے تو آپ کو خبر ملی کہ شام میں وبا پھیل گئی ہے۔ عبد الرحمن بن عوفؓ نے بتایا کہ رسول اللہ ﷺنے فرمایا ہے کہ«إِذَا سَمِعْتُمْ بِهِ بِأَرْضٍ فَلَا تَقْدَمُوا عَلَيْهِ، وَإِذَا وَقَعَ بِأَرْضٍ وَأَنْتُمْ بِهَا فَلَا تَخْرُجُوا فِرَارًا مِنْهُ»”جب تمہیں معلوم ہوجائے کہ کسی زمیں میں وبا پھیل گئی ہے تووہاں مت جاؤ اور اگر کسی ایسی زمین میں وبا پھیل جائے جہاں تم موجود ہو تو وہاں سے بھاگ مت نکلو” ۔ عمر ؓواپس ہوگئے… یعنی جب آپؓ کو خبر ملی کہ طاعون پھیل گیا ہے تووہ مسلمانوں کو لے کر واپس ہوگئے۔ اس لیے اسلامی ریاست وبا کو اس کے پیدائش کی جگہ محدود کرنے کی کوشش کرے گی، اس علاقے کے لوگ وہیں رہیں گے، دوسرے علاقے کے لوگ وہاں نہیں جائیں گے… اور ریاست ایک نگہبان اور امانت دار ریاست کے طور پر اپنی شرعی ذمہ داری ادا کرے گی۔ وبا پھیلنے کی صورت میں تمام رعایا کو صحت اور علاج معالجے کی تمام سہولیات مفت فراہم کرے گی، ہسپتال اور لیبارٹریوں کا بندوبست کرے گی،شہریوں کی بنیادی ضروریات اورتعلیم و امن وامان کا بندوبست کرے گی… مریضوں کو تندرست لوگوں سے الگ رکھنےکے لیے مریضوں کو قرنطینہ کرے گی، تندرست لوگوں کو اپنے کام جاری رکھنے، اجتماعی اقتصادی سرگرمیاں حسبِ سابق جاری رکھنے کی اجازت دے گی، تمام لوگوں کو گھروں میں بند کر کے معاشی زندگی کو مفلوج کرکے بحران کو بڑھا کر مشکلات میں اضافہ نہیں کرے گی…
تیسرا: تیل کی قیمتوں اور عالمی معیشت پر کرونا مرض کے اثرات:
اس وباء کے بغیر بھی عالمی معیشت کساد کا شکار تھی… ایسے حالات میں دنیا میں لاک ڈاؤن ، کلی اور جزوی محبوسی کے اقدامات کیسے کیے جاسکتے ہیں؟ یہ اقدامات اگر عالمی معیشت کونہ بھی گرائیں مگر اس کو مزید سست روی سے دوچار کردیں گے۔وائرس نے عالمی تجارتی سرگرمی کو مفلوج کردیا ہے اور تیل کی قیمتوں کوگرادیاہے۔ تیل کی قیمتیں کم ہونے اور روس کی جانب سے پیداوار بڑھانے پر مجبور ہونے سے اس کے اور سعودی عرب کے درمیان قیمتوں کی جنگ شروع ہوگئی ہے کیونکہ روس تیل پر زیادہ انحصار کرتاہے۔ یہی وجہ ہے کہ امریکہ نے سعودی عرب کو روس کے مقابلے میں پیداوار میں اضافے کےلیے متحرک کیا ۔ امریکی صدر ٹرمپ نے19مارچ 2020 کو یہ کہتے ہوئے روس کو دھمکی دی کہ”وہ مناسب وقت پر روس اور سعودی عر ب کے درمیان قیمتوں کی جنگ میں مداخلت کرے گا…” (امریکی ٹی وی الحرۃ، 19مارچ 2020) ۔ سعودی عرب روس کے ساتھ امریکہ کے مارکیٹ شئیر کی جنگ لڑ رہاہے۔ روس اور سعودی عرب کے درمیان پیداوار کم رکھنے کامعاہدہ تین سال جاری رہنے کے بعد ٹوٹ گیا۔ کرونا وائرس کے پھیلاؤ کے سبب عالمی منڈی میں تیل کی طلب کم ہونے سےدونوں ممالک مسائل کا شکار ہیں۔ تیل کی قیمتیں 20سال کی کم ترین سطح پر ہیں ۔ آنے والے معاہدوں کے لیے میکس برنٹ کی قیمت75. 28ڈالر ہے۔ روس سعودیہ کے امریکہ کے ساتھ گٹھ جوڑکو جانتاہے چنانچہ روسی روسنف کمپنی کے ترجمان میخائیل لیونیف نے روسی میڈیا سے بات کرتے ہوئے کہا کہ”کئی بار اوپیک پلس معاہدے کو جاری رکھنے کےلیے تیل کی پیداوار میں کمی کی گئی مگر بہت سرعت سے عالمی مارکیٹ میں اس کی جگہ امریکی شیل آئل کو لایا گیا” (رائٹرز، 18مارچ 2020) ۔ مگر وہ اس حوالے سے کسی قسم کے اقدامات نہ کرسکے پس سعودیہ نے بحران کا رخ روس کی طرف کردیا یوں 1، 2ملین بیریل کمی کرنے کے معاہدے کو جاری نہ رکھا جاسکا بلکہ پیداوار میں اضافہ کیا گیا، جس سے پیر کے دن تیل نے اپنی ایک تہائی قیمت کھودی جوکہ 1991کےخلیج جنگ کے بعد سب سے زیادہ خسارہ ہے…. یوں آنے والے معاہدوں کے لیے خام برنٹ کم ہوکر05. 31سے کم ہو کر 02. 31 پرفی بیرل آگیا، اس سے قبل31٪سے02. 31٪کم ہواتھا جوکہ 2010 کے بعد کم ترین سطح ہے(رائیٹرز19مارچ 2020) پھر اس نے اپنے ایشیائی گاہکوں کے لیے قیمت میں 6ڈالر کمی کی، اب روس اوپیک پلس معاہدے کی طرف دوبارہ لوٹنے کی کوشش کر رہاہے اور مزید کمی کے لیے نرمی دکھا رہاہے۔
یوں کرونا وائرس نے عالمی معیشت کو ہلاکر رکھ دیا ہے جس سے تیل کی قیمتیں گرگئیں اگر یہ سلسلہ جاری رہا تو خطرہ ہے عالمی معیشت زمین بوس ہوجائے گی…
چوتھا: کیا مساجد میں جمعہ اور جماعت کی نماز ترک کرناجائز ہے؟
وبا پھیلنے کی وجہ سے عمومی طور پر باجماعت نمازاور نمازِ جمعہ کو ترک نہیں کیا جاسکتا بلکہ صرف مریضوں کو الگ کر کےجماعت اور جمعہ کی نماز کے لیے انہیں مسجد آنے سے روکا جائے ، اگر ضرورت پڑے توصفائی ،جراثیم کشیاور ماسک کابندوبست کیا جائے… مگر تندرست لوگ بلا تعطل اپنی نماز جاری رکھیں ، اگر مشتبہ مریضوں کی چیک اَپ کی ضرورت ہو تو مساجد کے گیٹ پر طبی عملہ تعینات کیا جائے یعنی تندرست لوگوں کی نماز میں خلل کے بغیر مریضوں کے لیے حفاظتی اقدامات کیے جائیں کیونکہ جمعہ اور باجماعت نماز کے دلائل نماز کو مستقل طور پرمعطل کرنے کی اجازت نہیں دیتے اور جیسا ہم بیان کریں گے کہ ان کی ادائیگی کے لیے بہت بڑی تعداد کی بھی ضرورت نہیں،بعض مسلمانوں کو وجوہات کی بنا پر رخصت ہے ،اس کی وضاحت درج ذیل ہے:
باجماعت نماز فرضِ کفایہ ہے، لوگوں پر اس کا اہتمام فرض ہے ۔ابوداؤد نے روایت کیا کہ نبی صلی اللہ علیہ وسلم نے فرمایا :
«مَا مِنْ ثَلَاثَةٍ فِي قَرْيَةٍ وَلَا بَدْوٍ لَا تُقَامُ فِيهِمْ الصَّلَاةُ إِلَّا قَدْ اسْتَحْوَذَ عَلَيْهِمْ الشَّيْطَانُ، عَلَيْكَ بِالْجَمَاعَةِ فَإِنَّمَا يَأْخُذُ الذِّئْبُ مِنَ الْغَنَمِ الْقَاصِيَةَ»
"جس علاقے یا بستی میں تین آدمی ہوں اور وہ جماعت سے نماز نہ پڑھیں تو ان پر شیطان مسلط ہوگا ۔(مسلمانوں کی)جماعت کو لازم پکڑو ،بھیڑیا ریوڑ سے الگ ہونے والی بکری کو لے جاتاہے”
اس حدیث کوابوداؤد نے حسن اسناد سے روایت کیا ہے۔ یہ باجماعت نماز کے بارے میں ہے اور یہ فرض کفایہ ہے کیونکہ کچھ لوگوں نے رسول اللہ صلی اللہ علیہ وسلم کے ساتھ جماعت کی نماز نہیں پڑھی تو آپ نے ان کے گھروں کو جلانے کا ارادہ ظاہر کرکے پھر چھوڑ دیا۔ بخاری نے ابوہریرہؓ سے روایت کیا ہے کہ آپ صلی اللہ علیہ وسلم نے فرمایا:
«وَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ هَمَمْتُ أَنْ آمُرَ بِحَطَبٍ فَيُحْطَبَ ثُمَّ آمُرَ بِالصَّلَاةِ فَيُؤَذَّنَ لَهَا ثُمَّ آمُرَ رَجُلاً فَيَؤُمَّ النَّاسَ ثُمَّ أُخَالِفَ إِلَى رِجَالٍ فَأُحَرِّقَ عَلَيْهِمْ بُيُوتَهُمْ وَالَّذِي نَفْسِي بِيَدِهِ لَوْ يَعْلَمُ أَحَدُهُمْ أَنَّهُ يَجِدُ عَرْقاً سَمِيناً أَوْ مِرْمَاتَيْنِ حَسَنَتَيْنِ لَشَهِدَ الْعِشَاءَ»
"اس ذات کی قسم جس کے قبضے میری جان ہے، میرا دل کرتا ہے کہ لکڑیاں جمع کرنے کا حکم دوں اور لکڑیاں جمع کی جائیں پھر نماز کا حکم دوں اور اس کے لیے آذان دی جائے پھر کسی آدمی کولوگوں کی امامت کا حکم دوں اور میں جماعت میں نہ آنے والوں کے گھروں کو جا کر آگ لگادوں، اس ذات کی قسم جس کے قبضے میں میری جان ہے اگر كسى كو معلوم ہو جائے كہ اسے موٹى سے گوشت والى ہڈى حاصل ہو گى، يا پھر اسے اچھے سے دو پائے كے كھر حاصل ہونگے تو وہ عشاء كى نماز ميں حاضر ہوں گے”۔
اگر جماعت فرضِ عین ہوتی تو آپ ﷺ انہیں نہ چھوڑتے۔ یہ باجماعت نمازکے بارے میں ہے کیونکہ اس میں عشاء کی جماعت کا ذکر ہے۔ جماعت کم سے کم ایک مقتدی اور امام کے ساتھ ہوتی ہے، جیسا کہ مالک بن حویرث سے روایت ہے کہ"«أَتَيْتُ النَّبِيَّ ﷺأَنَا وَصَاحِبٌ لِي فَلَمَّا أَرَدْنَا الْإِقْفَالَ مِنْ عِنْدِهِ قَالَ لَنَا إِذَا حَضَرَتْ الصَّلَاةُ فَأَذِّنَا ثُمَّ أَقِيمَا وَلْيَؤُمَّكُمَا أَكْبَرُكُمَا»میں اور میرا ایک ساتھی رسول اللہ صلی اللہ علیہ وسلم کے پاس آئے، جب جانے لگے توآپ ﷺ نے فرمایا جب نماز کا وقت ہو تو آذان دینا،پھرایک اقامت کرے اورجو بڑا ہے وہ امامت کرے” اسےمسلم نےروایت کیا ہے۔ شرعی عذر کے بغیر جماعت ساقط نہیں ہوتی جیسا کہ رات کی تاریکی اور بارش کا ذکر بخاری میں ہے کہ
كَانَ يَأْمُرُ مُؤَذِّناً يُؤَذِّنُ ثُمَّ يَقُولُ عَلَى إِثْرِهِ أَلَا صَلُّوا فِي الرِّحَالِ فِي اللَّيْلَةِ الْبَارِدَةِ أَوْ الْمَطِيرَةِ فِي السَّفَر
"سخت سردی کی رات میں یا سفر کے دوران رسول اللہ صلی اللہ علیہ وسلم موذن سے کہتے آذان دو، وہ آذان دیتا، اس کے بعد اعلان کرتا کہ اپنے ٹھکانوں پر ہی نماز پڑھ لو"۔
اور جہاں تک جمعہ کی نماز کا تعلق ہے ،تو وہ فرضِ عین(ہر مسلمان پر فرض ) ہے جو صرف شرعی عذر سے ہی ساقط ہوسکتی ہے اس کے دلائل بہت ہیں، اللہ کا یہ ارشاد:﴿إِذَا نُودِي لِلصَّلاَةِ مِنْ يَوْمِ الْجُمُعَةِ فَاسْعَوْا إِلَى ذِكْرِ اللَّهِ وَذَرُوا الْبَيْعَ﴾ ” جب جمعہ کے دن نماز کے لیے آذان دی جائے تو اللہ کے ذکر کی طرف دوڑو اور تجارت ترک کردو"۔ اس آیت میں امر وجوب کےلیے ہے جس کی دلیل یہ قرینہ ہے کہ یہاں مباح (تجارت)سے منع کیا جا رہا ہے ،پس یہ طلب حتمی طلب ہے۔ حاکم نے المستدرک علی الصحیحین میں طارق بن شہاب سے پھر ابوموسیٰ سے روایت کیا ہے کہ انہوں نے نبی صلی اللہ علیہ وسلم سے روایت کیا ہے کہ«الْجُمُعَةُ حَقٌّ وَاجِبٌ عَلَى كُلِّ مُسْلِمٍ فِي جَمَاعَةٍ إِلَّا أَرْبَعَةٌ: عَبْدٌ مَمْلُوكٌ، أَوِ امْرَأَةٌ، أَوْ صَبِيٌّ، أَوْ مَرِيضٌ»” جمعہ ہر مسلمان پر جماعت کے ساتھ ایک واجب حق ہے ،سوائے چار افراد کے غلام، عورت، بچہ اور مریض "۔اور امام حاکم نے بیان کیا کہ یہ حدیث شیخین (بخاری و مسلم)کی شرط پر صحیح ہے۔ یہ خوف زدہ پر بھی فرض نہیں جیسا کہ ابنِ عباسؓ نے رسول اللہ صلی اللہ علیہ وسلم سے روایت کیا:«مَنْ سَمِعَ النِّدَاءَ فَلَمْ يُجِبْهُ فَلَا صَلَاةَ لَهُ إلَّا مِنْ عُذْرٍ، قَالُوا: يَا رَسُولَ اللهِ وَمَا الْعُذْرُ؟ قَالَ: خَوْفٌ أَوْ مَرَضٌ» "جوشخص آذان سنے اور اس کا جواب نہ دے تو اس کی نماز نہیں سوائے عذر کے لوگوں نے کہا: اے اللہ کے رسول عذر کیا ہے؟ فرمایا خوف یا مرض” اس کو بیھقی نے سنن الکبریٰ میں روایت کیا ہے۔ اس لیے جمعہ ہر مسلمان پر فرض ہے سوائے اس کے جس کا عذر نص میں وارد ہے اور اسی کو استثنیٰ حاصل ہے… ان کے علاوہ سب پر جمعہ فرضِ عین ہے صرف مذکورہ عذر شرعی عذر ہیں۔ ان پر کسی اور عذر کو قیاس نہیں کیا جاسکتا کیونکہ شرعی عذر وہ ہوتاہے جو شرعی نص میں وارد ہو اور عبادات میں قیاس نہیں ہوتاکیونکہ عبادات میں علت والی نصوص ہی نہیں ہیں اس لیے قیاس بھی نہیں…
جمعہ کی نماز کے لیے شرط ہے کہ اس میں مسلمانوں کی تعدادہو مگر یہ تعداد متعین نہیں ، صحابہ کا اس بات پر اجماع ہے کہ جمعہ کی نماز میں تعداد کا ہونا لازمی ہے، پس ضروری ہے کہ اس میں تعداد ہو۔ اس میں کسی متعین عدد کی شرط نہیں ، پس کوئی بھی تعداد جس پر جماعت کا اطلاق ہو اس کے ساتھ جمعہ کی نماز ہو جائے گی جب تک کہ وہ جماعت سمجھی جائے۔ چونکہ جماعت کا ہونا طارق سے مروی سابقہ حدیث سے ثابت ہے «الْجُمُعَةُ حَقٌّ وَاجِبٌ عَلَى كُلِّ مُسْلِمٍ فِي جَمَاعَةٍ»”جمعہ حق اور ہر مسلمان پر جماعت کے ساتھ فرض ہے” اور چونکہ تعداد کا ہونا اجماعِ صحابہؓ سے ثابت ہے اور کوئی ایسی حدیث نہیں جو کسی متعین تعدادپر دلالت کرتی ہو، جبکہ جماعت اور تعداد کا ہونا ضروری ہے ، پس یہ تین یا تین سےزیادہ سے ہی حاصل ہو سکتی ہےکیونکہ دو کو تعداد والی جماعت نہیں کہاجاتا، اس لیے لازمی ہے کہ جمعہ کے صحیح ہونے کے لیے تین یا اس سے زیادہ لوگ ہوں، چنانچہ تین سے کم افراد کا جمعہ پڑھنا درست نہیں نہ ہی اسے جمعہ کہاجائے گا،تعداد کے عدم وجود کی وجہ سے۔ جمعہ کے لیے تعداد ہونے پر صحابہ کا اجماع ہے۔
یہی وجہ ہے کہ ریاستِ خلافت جمعہ یاجماعت کی نماز کو معطل نہیں کرے گی بلکہ صرف شرعی طور پرمعذور افراد شریک نہیں ہوں گے، باقی لوگ جماعت میں شریک ہوں گے۔ رہی یہ بات کہ اگر غالب گمان ہو کہ سبھی لوگ وبا کا شکار ہو جائیں گے اور تمام تر احتیاطی تدابیر کے باوجود اس سے بچنا ممکن ہی نہیں…تو اس کا امکان بہت کم ہے ،خاص طورپر جبکہ جماعت کے لیے کم از کم تعداد دو ہے اور جمعہ کے لیے تین ہے اور اسے حاصل کرنا غالب طور پرممکن ہے ،تو اگرکسی علاقے میں یہ فرض بھی کر لیا جائے کہ ایسی صورتِ حال ہے تو اسی ترتیب کو اختیار کیا جائے ۔ اور حکم کو تمام تر کوشش اور ذمہ دار ی کے ساتھ برقرار رکھنا لازم ہے ۔ اگر تعداد کو حاصل کرنے کا غالب گمان ہو تو جماعت اور جمعہ کو معطل نہیں کیا جائے بلکہ تمام تر احتیاطی تدابیر اختیار کی جائیں ، اور فرض کو ترک کرنے سے بچا جائے اور اسے احتیاطوں اور تدابیر کے ساتھ قائم کیا جائے تاکہ بیماری ایک سے دوسرے کو نہ لگے۔
اس مسئلے میں یہ راجح حکم ہے، اس لیے حکمران اگر مذکورہ غالب گمان کے بارے میں پوری تحقیق کیے بغیر مساجد کو بند کریں، جیسا کہ اوپر بیان کیا گیا اور لوگوں کو جمعہ اور جماعت سے روکیں تو وہ باجماعت نماز اور جمعہ کو معطل کرنے پر سخت گنہگار ہوں گے.
