اسلام و علیکم ورحمۃ اللہ و برکاتہ
’نظام الاسلام ‘ کے مطابق، فرض کی تعریف یہ ہے کہ فرض وہ عمل ہے کہ جس کی ادائیگی کرنے والے کو سراہا جائے اور اس میں غفلت برتنے یا چھوڑنے والے کی مذمّت کی گئی ہو۔ جبکہ ’اسلامی شخصیہ‘جلد -3 میں فرض کی یہ تعریف کی گئی ہے کہ جو شخص اس کی ادائیگی کو نظر انداز کرتا ہے وہ سزا کا حقدار ہے مگر اس میں سراہے جانے کو واضح نہیں کیا گیا ۔ تو اصل استنباط کی گئی تعریف کیا ہے؟

وعلیکم اسلام ورحمۃ اللہ و برکاتہ
‘نظام الاسلام’ اور ‘اسلامی شخصیہ’ جلد-3 میں دی گئی تعریفوں میں تحقیق کے پس منظر کے سوا کوئی فرق نہیں ؛ ’نظام الاسلام‘ میں دی گئی تعریف عمومی تعریف کے قریب تر ہے جو فرض کے قرینے connotationتک محدود نہیں ہے یعنی کسی کام کو سرانجام دینے یا ترک کرنے کے لازم ہونے کے قرینے تک۔
’نظام الاسلام‘ میں یہ واضح ہے کہ: فرض اور واجب وہ عمل ہے جس کے کرنے والے کی تعریف کی جائے اور نہ کرنے والے کی مذمت کی جائے ،یااسے چھوڑنے والاسزا کا مستحق قرار پائے۔ حرام وہ عمل ہے جس کے کرنے والے کی مذمت کی جائے اور چھوڑنے والے کی تعریف کی جائے یاکرنے والا سزاکا مستحق ہو”۔ لہٰذا اس میں عمومی تعریف واضح کی گئی ہے۔ ’مذمّت اور تعریف‘ اور اسی کے ساتھ ساتھ فرض کے لئے ’جزم کا قرینہ‘ واضح کیا گیا ہے:”اسے چھوڑنے والاسزا کا مستحق قرار پائے”۔ عمل کرنے والے کی تعریف کرنے کا لازمی یہ مقصد نہیں کہ وہ عمل فرض ہی ہو۔ یہ مندوب عمل بھی ہو سکتا ہے۔ جبکہ عمل کے چھوڑے جانے پر سزا کا حقدار ہونا ہی ’جزم-لازمیت/حتمیت‘ کو ظاہر کرتا ہے ۔لہٰذا جب کتاب نے حرام عمل کے لئے جزم کے قرینے کا ذکر کیا تو کہا گیا کہ : "جو شخص حرام عمل کرتا ہے وہ سزا کا مستحق ہے”۔
جہاں تک ’اسلامی شخصیہ جلد-3 ‘ میں فرض کی تعریف کا تعلق ہے، تویہ اصول کی تحقیق ہے جس میں جزم کے قرینے پر توجہ مرکوز کی گئی ہے نہ کہ عمومی تعریف پر۔ لہٰذا یہ کہا گیا ہے کہ”واجب کا معاملہ یہ ہے کہ جو بغیر کسی شک وشبہ کے جان بوجھ کر اس سے پرہیز کرتا ہے اس کی قانونی طور پر مذمّت کی گئی ہے”۔ قانونی طور پر مذمّت سے مراد یہ ہے کہ یہ قرآن ، رسول اللہ ﷺ کی سنت یا اجماعِ صحابہ سے ملتا ہے کہ اگر واجب کو ترک کیا جاتا ہے تو وہ شخص ناقص اور قابل الزام ہوگا۔ عمل کے چھوڑے جانے پر لوگوں کی مذمّت کو خاطر میں نہیں لایا گیا بلکہ جو بات اہم ہے وہ شریعت کی مذمّت ہے۔۔۔۔
اور اگر شارع کا خطاب فیصلہ کن طور پر کسی عمل سے بچنے کے متعلق ہے تو وہ عمل حرام ہے اور ’محظور‘ کے ہم معنی ہے جس کا مطلب ہے کہ جو شخص حرام عمل کرے گا وہ شریعت کے تحت قابلِ مذمّت ہے۔
تو یہاں کتاب قرینے کو توجّہ کا مرکز بناتی ہےکہ جو(حتمیت -جزم) کو ظاہر کرے۔یہاں پر مذمّت کی بات کی گئی مگر سراہے جانے پر توجّہ نہیں کی گئی۔ اس کی وجہ یہ ہے کہ کسی عمل کے کیے جانے پر ایک شخص کی مذمّت کی جائے تو وہ عمل حرام عمل ہے۔ لہٰذا مذمّت کیا جانا حتمی ہونے (جزم) کو ظاہر کرتا ہے اور اگر کسی عمل کے چھوڑے جانے پر مذمّت ہو تو یہ فرض ہے۔ جیسا کہ آپ نے دیکھا کہ یہاں سراہا جانا ذکرنہیں کیا کیونکہ سراہا جانا فیصلہ کن (جزم) نہیں۔ یہ پہلے ہی واضح ہے کہ صرف فرض کی ادائیگی کرنے والے کو ہی نہیں سراہا جاتا بلکہ مندوب عمل کرنے والے کو بھی سراہا جاتا ہے۔
نتیجتاً جو "نظام الاسلام” میں لکھا گیا ہے وہ زیادہ وسیع اور عمومی ہے۔ جہاں کہا گیا کہ فرض اور واجب وہ عمل ہے جس کے کرنے والے کی تعریف کی جائے اور نہ کرنے والے کی مذمت کی جائے ،یااسے چھوڑنے والاسزا کا مستحق قرار پائے۔ حرام وہ عمل ہے جس کے کرنے والے کی مذمت کی جائے اور چھوڑنے والے کی تعریف کی جائے یاکرنے والا سزاکا مستحق ہو”۔ اور جہاں تک ’اسلامی شخصیہ جلد-3‘ میں بات کی گئی تواس میں توجّہ کا مرکز حتمیت (جزم) کا قرینہ ہے، جہاں کہا گیا ہے کہ واجب وہ عمل ہے جسے جان بوجھ کر ترک کرنے والاشرعی طور پر قابلِ مذمّت ہے۔
شرعی طور پر مذمّت سے مراد ہےکہ کتاب اللہ، سنت رسول ﷺاور اجماعِ صحابہؓ سے اس بات کی دلیل ملتی ہو کہ اس عمل کوترک کرنے والا شخص ناقص اور قابلِ مذمّت ہوگا۔
اس عمل کے چھوڑے جانے پرل وگوں کی مذمّت قابل التفات نہیں بلکہ جو چیز معتبرہے وہ شرعی طور پر مذمّت ہے۔ اور اگر شارع کا خطاب فیصلہ کن انداز میں کسی عمل کے چھوڑے جانے سے متعلق ہے تو وہ عمل حرام ہے اور حرام اور محظور مترادف ہیں۔ اور حرام وہ ہے جسے کرنے والا شرعی طور پر مذمّت کے قابل ہے۔
