آئین کا معاملہ
پاکستان کو آج صرف سیاسی قیادت کے ہی بحران کا سامنا نہیں ،جب مسلمان "قیادت کے فقدان” پر افسوس کرتے نظر آتے ہیں، بلکہ اسے نظریاتی قیادت کے بحران کا بھی سامنا ہے،جہاں مسلمان یہ محسوس کرتے ہیں کہ موجودہ حکمرانی، نظام اور نظم و نسق ناکام ہو چکے ہیں۔ سوال صرف یہ نہیں ہے کہ "کس کی حکومت” ہونی چاہیے بلکہ سوال یہ ہے کہ”کس بنیاد پر” حکمرانی استوار ہونی چاہیے ۔ یہ صرف شناخت کا مسئلہ نہیں بلکہ ایک مفصل، نظریاتی عالمی نقطۂ نظر کا معاملہ ہے۔
پاکستان مسلم دنیا میں نظریاتی بحران کا سامنا کرنے میں اکیلا اور منفرد نہیں ہے ۔ 28 رجب 1342 ہجری بمطابق 3 مارچ 1924 کو خلافت کے خاتمے کے بعد سے، مسلم امت ایک ایسے آئین کے بغیرزندگی گزار رہی ہے جو قرآنِ کریم اور سنتِ مبارکہ سے ماخوذ ہو۔ اس کے بعد سے، مسلم دنیا پر آمریت، بادشاہت، صدارتی جمہوریت اور پارلیمانی جمہوریت کے ملغوبوں کے ذریعے حکومت کی گئی ہے۔ تاہم مسلمان بدستور معاشی بدحالی اور اپنی سلامتی کے حوالے سے ذلت و رسوائی میں ڈوبتے جا رہے ہیں۔اپنی سمت واضح نہ ہونے کی وجہ سے مراکش سے انڈونیشیا تک مسلم دنیا پر بدامنی حاوی ہے۔
مارچ 1940 کی قراردادِ لاہور واضح طور پر اس حد تک آگے نہ بڑھ سکی کہ جونظریہ کےاس بحران کو حل کرنے کے لیے درکارہے۔ 23 مارچ 1956 کو پاکستان کے پہلے آئین نے مسلمانوں کے لیے ایک وطن کے پہلو پر زور دیتے ہوئے برطانوی ولی عہد کے اقتدار سے صدارتی جمہوریت کی طرف منتقلی کا نشان لگایا۔ تاہم نظریے کا بحران برقرار رہا۔ 1973 کے آئین میں بھی نظریے کے معاملے پر توجہ نہیں دی گئی۔ اس نے محض فوجی بالادستی کے مقابلے میں سویلین بالادستی کے توازن کو صدارتی جمہوریت سے پارلیمانی جمہوریت میں تبدیلی کے ذریعے بدل دیا۔
پاکستان کا نظریاتی بحران چیف ایگزیکٹیو کی شناخت کے مسلمان، سویلین یا فوجی افسر ہونے سے حل نہیں ہوگا۔ اس بحران کا حل آئین کی اصل اور بنیاد کو مخاطب کرنے سے ہی حل ہو سکتا ہے۔ بحران کا حل کسی ایسے آئین سے نہیں ہو سکتا جو مکمل طور پر یا جزوی طور پر ان قوانین سے اخذ کیا گیا ہو جو انسانوں کے طے کردہ ہیں۔ ستر سال سے زائد عرصے گزر جانے کے بعد پاکستان کے حالات سے یہ بات واضح ہو جاتی ہے۔
پاکستان کا نظریاتی بحران ایک ایسے آئین کو اپنا کر ہی حل کیا جا سکتا ہے جس کی ہر شق کی جڑیں قرآن مجید اور سنت نبوی ﷺ میں موجود ہوں۔ حزب التحریر نے ایک ایسا آئین تیار کیا ہے، جو چودہ سو سال قبل شروع ہونے والی بھرپور اسلامی فقہی روایت پر مبنی ہے۔ یہی وہ آئین ہے جسے اب نظریاتی بحران کے خاتمے کے لیے عوامی بحث اور نجی مطالعے کا مرکز بننا چاہیے۔ یہی ایک ایسی بحث اور مطالعہ ہے جو دستور کو اپنانے کیلئے نبوت کے طریقے پر خلافت کے قیام کی طرف ایک عملی، اور بنیادی طور پر اہم کردار ادا کرے گا ۔
