سوال:
السلام علیکم ورحمۃ اللہ و برکاتہ۔ہمارے امیر،اللہ آپ پر رحمت نازل کرے،آپ کو نصرت عطا کرے اور فتح مبین اور نبوت کے نقش قدم پر خلافت نصیب کرے جس سے مومنوں کے دلوں کو اطمینان حاصل ہو۔
نئی ویکسین جس کو کئی ممالک نے کرونا سے بچنے کے لیے اپنی اقوام کو لگانا شروع کر دیا ہے، میرا سوال اس کے حوالے سے ہے۔اس ویکسین کے خطرات کے حوالے سے سوشل میڈیا میں پھیلنے والی بہت ساری افواہوں کی وجہ سے اس کے متعلق بہت زیادہ خوف پایا جاتاہے،کہاجارہا ہے کہ یہ سرمایہ داروں کی جانب سے اقوام کے خلاف عالمی سازش ہے۔ ہاں شفاء تو صرف اللہ کے ہاتھ میں ہے اورہرموت کا ایک وقت مقرر ہے۔ ہم بطور داعی ہونے کے اس ویکسین کی حقیقت کے بارے میں سوال کررہے ہیں کہ اس وباء کے دوران اس ویکسین کو لگانا شرعا واجب ہے یا نہیں؟
جواب:
وعلیکم السلام ورحمۃ اللہ وبرکاتہ۔جیسا کہ آپ جانتی ہیں کہ ہم نے علاج کے حوالے سے پہلے بھی سوالات کے جوابات دیے ہیں جن میں ہم نے کہا:
– دوائی میں اگر کوئی ضرر ہو تو وہ اس حدیث»لَا ضَرَرَ وَلَا ضِرَارَ«،یعنی”نہ نقصان قبول کرنا ہے نہ پہنچاناہے” کے مطابق اس کا استعمال حرام ہے۔
– لیکن اگر دوائی میں کوئی ضرر نہ ہو مگر اس میں حرام یا ناپاک مواد شامل ہو تو اس کو استعمال کرنا مکروہ ہے، یعنی حرام نہیں، بلکہ اس کا استعمال اگر مریض کو مباح دوائی میسر نہ ہو تو اس کا استعمال جائز مگر مکروہ ہے۔
– اگر دوائی میں ضرر نہ ہو اور اس میں حرام یا ناپاک مواد بھی شامل نہ ہو تو اس کا استعمال مندوب ہے۔
میں ان جوابات میں سے جوآپ کے سوال سے متعلق ہے وہ آپ کے سامنے پیش کرتا ہوں:
]اول: حرام اور ناپاک چیز سے علاج کرنے کے حوالے سے26 جنوری 2011 کےسوال کے جواب سے جس میں یہ آیا:
(۔۔3-دوا ئی تحریم سے مستثنی ہے، حرام اور ناپاک چیز سے علاج حرام نہیں۔
– حرام چیز سے علاج کے حرام نہ ہونے کی دلیل مسلم کی یہ حدیث ہے جو انسؓ سے روایت ہے:
»رَخَّصَ رَسُولُ اللَّهِ ﷺ أَوْ رُخِّصَ لِلزُّبَيْرِ بْنِ الْعَوَّامِ وَعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ فِي لُبْسِ الْحَرِيرِ لِحِكَّةٍ كَانَتْ بِهِمَا«
"رسول اللہ ﷺ نے خارش کی وجہ سے زبیر بن العوامؓ اور عبدالرحمن بن عوفؓ کو ریشم پہننے کی اجازت دی”
اگرچہ مردوں کے لیے ریشم پہننا حرام ہے مگر علاج کے لیے اسے جائز کیا گیا۔
– جہاں تک ناپاک شے سے علاج کے حرام نہ ہونے کی دلیل ہے بخاری میں انسؓ سے روایت ہے :
»أَنَّ نَاساً اجْتَوَوْا فِي الْمَدِينَةِ فَأَمَرَهُمْ النَّبِيُّ ﷺ أَنْ يَلْحَقُوا بِرَاعِيهِ يَعْنِي الْإِبِلَ فَيَشْرَبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا فَلَحِقُوا بِرَاعِيهِ فَشَرِبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا۔۔۔«
"کچھ لوگ مدینہ میں بیمار ہوئے تو نبی ﷺ نے ان کو حکم دیا کہ وہ اونٹوں کے چرواہے سے ملیں اور اونٹوں کا دودھ اور ان کا پیشاب پئیں، وہ چرواہے سے جاملے اور اونٹوں کا دودھ اور پیشاب پیا۔۔۔”
لفظ اجْتَوَوْا کا مطلب ہے کہ مدینہ کے کھانے ان کو راس نہ آئے ،لہٰذا وہ بیمار ہوئے تو رسول اللہ ﷺ نے ان کو پیشاب سے علاج کی اجازت دی جو ناپاک ہے۔۔۔) اقتباس ختم ہوا۔
دوئم:19 ستمبر 2013 کے سوال کے جواب میں آیا:
(دوا ئی میں الکوحل کا استعمال یا کسی ایسی دوائی کا استعمال میں جس میں الکوحل ملا ہو، جائز کے حکم میں آتا ہے اگرچہ یہ مکروہ ہے۔ اس کی دلیل یہ ہے:
ابن ماجہ نے طارق بن سوید الحضرمی سے روایت کیا ہے کہ انہوں نے کہا:
»قُلْتُ يَا رَسُولَ اللَّهِ إِنَّ بِأَرْضِنَا أَعْنَاباً نَعْتَصِرُهَا فَنَشْرَبُ مِنْهَا قَالَ لَا فَرَاجَعْتُهُ قُلْتُ إِنَّا نَسْتَشْفِي بِهِ لِلْمَرِيضِ قَالَ إِنَّ ذَلِكَ لَيْسَ بِشِفَاءٍ وَلَكِنَّهُ دَاءٌ«
"میں نے کہا:یا رسول اللہ ﷺ!ہماری زمین میں انگور ہیں ہم اس کا رس نچوڑتے ہیں جس میں سے پیتے ہیں،آپ ﷺ نے فرمایا: نہیں۔ میں نے دوبارہ کہا: ہم اس سے مریض کا علاج کرتے ہیں،آپ ﷺ نے فرمایا: یہ شفا نہیں بیماری ہے”۔
اس میں حرام یا ناپاک”شراب” کو دوائی کے طور پر استعمال کرنے سے منع کیا گیا ہے مگر رسول اللہ ﷺ نے اونٹ کے ناپاک پیشاب کو دوا ئی کے طور پر استعمال کرنے کی اجازت دی۔ بخاری نے انسؓ سے روایت کی ہے:
»أَنَّ نَاساً مِنْ عُرَيْنَةَ اجْتَوَوْا الْمَدِينَةَ فَرَخَّصَ لَهُمْ رَسُولُ اللَّهِ ﷺ أَنْ يَأْتُوا إِبِلَ الصَّدَقَةِ فَيَشْرَبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا۔۔۔«
"عرینہ کے کچھ لوگ مدینہ (کی آب وہوا یا خوراک کی وجہ سے)بیمار ہوئے تو رسول اللہ ﷺ نے ان کو اجازت دی کہ وہ صدقہ کے اونٹوں کے پاس جائیں اور ان کا دودھ اور پیشاب پی لیں۔۔۔۔”
یعنی مدینہ کی آب وہوا ان کو راس نہ آئی اور وہ بیمار ہوگئے تو رسول اللہ ﷺ نے ان کو اونٹ کےناپاک پیشاب سے علاج کرنے کی اجازت دی۔ اسی طرح رسول اللہ ﷺ نے حرام سے علاج کرنے کی بھی اجازت دی جیسے ریشم پہننے کی۔ ترمذی اور احمد نے انس کے حوالے روایت کی ہے اور الفاظ ترمذی کے ہیں:
»أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ وَالزُّبَيْرَ بْنَ الْعَوَّامِ شَكَيَا الْقَمْلَ إِلَى النَّبِيِّ ﷺ فِي غَزَاةٍ لَهُمَا، فَرَخَّصَ لَهُمَا فِي قُمُصِ الْحَرِيرِ. قَالَ: وَرَأَيْتُهُ عَلَيْهِمَا«
"عبد الرحمن بن عوفؓ اور زبیر بن عوام ؓنے ایک غزوۃ کے دوران رسول اللہ ﷺ سے خارش کی شکایت کی تو آپ ﷺ نے ان کو ریشم پہننے کی اجازت دی۔ راوی کہتا ہے: میں نے ان کو ریشمی کپڑوں میں دیکھا”
یہ دونوں احادیث اس بات کا اشارہ دیتی ہیں کہ ابن ماجہ کی حدیث میں موجود نہی کا قرینہ جازم نہیں یعنی حرام اور نجس سے علاج حرام نہیں مکروہ ہے)۔
سوئم:18 نومبر 2013میں ویکسین اور اس کے حکم کے حوالے سے سوال کے جواب میں آیا ہے:
(ویکسین لگوانا دوا ئی ہے اور دوا ئی استعمال کرنا مندوب ہے، فرض نہیں اس کی دلیل یہ ہے:
1۔بخاری نے ابوہریرہؓ سے روایت کی کہ رسول اللہ ﷺ نے فرمایا:
»مَا أَنْزَلَ اللَّهُ دَاءً إِلَّا أَنْزَلَ لَهُ شِفَاءً «
” اللہ نے ایسی کوئی بیماری نہیں اتاری جس کیلئے شفاء نہ اتاری ہو”
مسلم نے جابر بن عبد اللہ ؓسے روایت کی ہے کہ نبی ﷺ نے فرمایا:
»لِكُلِّ دَاءٍ دَوَاءٌ، فَإِذَا أُصِيبَ دَوَاءُ الدَّاءِ بَرَأَ بِإِذْنِ اللهِ عَزَّ وَجَلَّ«
” ہر بیماری کی ایک دوا ئی ہے، جب وہ دوائی دی جائے جو بیماری کی ہو تو اللہ عزو جل کے حکم سے اسے ٹھیک کر دیتی ہے”
احمد نے اپنے مسند میں عبداللہ بن مسعودؓ سے روایت کی ہے :
»مَا أَنْزَلَ اللَّهُ دَاءً، إِلَّا قَدْ أَنْزَلَ لَهُ شِفَاءً، عَلِمَهُ مَنْ عَلِمَهُ، وَجَهِلَهُ مَنْ جَهِلَهُ«
"اللہ نے جو بھی بیماری اتاری ہے اس کے لیے دوائی بھی اتار دی ہے ،اسے جاننے والے اسے جانتے ہیں اوراسے نہ جاننے والے اسے نہیں جانتے”
ان احادیث میں یہ فرمایا گیا ہے کہ ہر بیماری کی ایک دوا ئی ہے جو اس میں شفا بخش ہے، جو اس بات پر حوصلہ افزائی کرتی ہے کہ علاج کرنا چاہیے اسی میں شفاء ہے مگر یہ راہنمائی ہے واجب نہیں۔
2۔ احمد نے انسؓ سے روایت کیا ہے کہ رسول اللہ ﷺ نے فرمایا:
»إِنَّ اللَّهَ حَيْثُ خَلَقَ الدَّاءَ، خَلَقَ الدَّوَاءَ، فَتَدَاوَوْا«
” اللہ نے جہاں بیماری پیدا کی اس کی دوا ئی بھی پیدا کی ہے، اس لیے علاج کرو”
ابوداؤد نے اسامہ بن شریک سے روایت کی ہےجو کہتے ہیں:
أَتَيْتُ النَّبِيَّ ﷺ وَأَصْحَابَهُ كَأَنَّمَا عَلَى رُءُوسِهِمُ الطَّيْرُ، فَسَلَّمْتُ ثُمَّ قَعَدْتُ، فَجَاءَ الْأَعْرَابُ مِنْ هَا هُنَا وَهَا هُنَا، فَقَالُوا: يَا رَسُولَ اللَّهِ، أَنَتَدَاوَى؟ فَقَالَ: »تَدَاوَوْا فَإِنَّ اللَّهَ عَزَّ وَجَلَّ لَمْ يَضَعْ دَاءً إِلَّا وَضَعَ لَهُ دَوَاءً، غَيْرَ دَاءٍ وَاحِدٍ الْهَرَمُ« أي إلا الموت
” میں نبی ﷺ اور صحابہؓ کے پاس آیا،وہ ایسے بیٹھے ہوئے تھے گویا ان کے سروں پر پرندے بیٹھے ہوں، میں سلام کرکے بیٹھ گیا، پھر دیہاتی ادھر ادھر سے آگئے اور کہا:یا رسول اللہ ﷺ!کیا ہم علاج کریں؟ آپ ﷺ نے فرمایا: علاج کیا کرو کیونکہ اللہ نے کوئی ایسی بیماری پیدا نہیں کی جس کی دوائی پیدا نہ کی ہو سوائے ایک بیماری کے، یعنی موت "
پہلی حدیث میں علاج کا حکم ہے اور اس حدیث میں دیہاتیوں کو علاج کرنے کا جواب دیا، جس میں بندوں کو خطاب ہے کہ علاج کرو، کیونکہ اللہ نے کوئی ایسی بیماری پیدا نہیں کی جس کی شفاء پیدا نہ کی ہو ۔دونوں احادیث میں خطاب امر کے صیغے سے ہے، امرسے مطلق طلب کاعلم ہوتا ہے،واجب ہونے کا نہیں۔واجب ہونےکا علم تب ہوتا ہے جب امر جازم ہو اور جزم کےلیے قرینہ کی ضرورت ہے، اور دونوں احادیث میں وجوب پر دلالت کرنے والا کوئی قرینہ نہیں، اس کے علاوہ علاج نہ کرنے کے جائز ہونے کے بارے میں بھی احادیث ہیں، جو ان دونوں احادیث سے وجوب کے ثابت ہونے کی نفی کرتی ہیں۔ مسلم نے عمران بن حصین سے روایت کی ہے کہ نبی ﷺ نے فرمایا:
»يَدْخُلُ الْجَنَّةَ مِنْ أُمَّتِي سَبْعُونَ أَلْفاً بِغَيْرِ حِسَابٍ»، قَالُوا: وَمَنْ هُمْ يَا رَسُولَ اللهِ؟ قَالَ: «هُمُ الَّذِينَ لَا يَكْتَوُونَ وَلَا يَسْتَرْقُونَ، وَعَلَى رَبِّهِمْ يَتَوَكَّلُونَ«
” میری امت کے سترہزار لوگ بغیر حساب کے جنت میں داخل ہوں گے ۔ کہا گیا: وہ کون لوگ ہیں یا رسول اللہ ﷺ؟ فرمایا: وہ لوگ جو (آگ سے)داغنے اوررقیہ(دم کرنا) نہیں کرتے اور اپنے رب پر بھروسہ کرتے ہیں”
داغنااوررقیہ(دم کرنا) علاج ہی کی ایک قسم ہے۔بخاری نے ابن عباسؓ سے روایت کی ہے کہ انہوں نے کہا:
…هَذِهِ المَرْأَةُ السَّوْدَاءُ، أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ: إِنِّي أُصْرَعُ، وَإِنِّي أَتَكَشَّفُ، فَادْعُ اللَّهَ لِي، قَالَ: «إِنْ شِئْتِ صَبَرْتِ وَلَكِ الجَنَّةُ، وَإِنْ شِئْتِ دَعَوْتُ اللَّهَ أَنْ يُعَافِيَكِ» فَقَالَتْ: أَصْبِرُ، فَقَالَتْ: إِنِّي أَتَكَشَّفُ، فَادْعُ اللَّهَ لِي أَنْ لاَ أَتَكَشَّفَ، «فَدَعَا لَهَا۔۔۔«
” ۔۔۔یہ سیاہ عورت رسول اللہ ﷺ کے پاس آئی اور کہا: مجھے دورے پڑتے ہیں اور میں بے پردہ ہوجاتی ہوں، میرے لیے اللہ سے دعا کریں۔آپ ﷺ نے فرمایا: "اگر تم چاہو تو صبر کرو تمہارے لیے جنت ہے،اور اگر چاہو تو میں تمہارے لیے دعا کروں گاکہ اللہ تمہیں تندرست کرے،اس نے کہا:میں صبر کروں گی، آپ اللہ سے دعا کریں کہ میں بے پردہ نہ ہوجاؤں۔پھر آپ ﷺ نے اس کے لیے دعا کی۔۔۔”
یہ دونوں احادیث علاج ترک کرنے کے جائز ہونے پر دلالت کرتی ہیں۔
یہ سب اس بات پر دلالت کرتا ہے کہ امر،"فتداووا”، "تداووا"،یعنی”پس علاج کرو” ،”علاج کرو”کے الفاظ وجوب کے لیے نہیں، لہذا یہاں پر امریا تو اباحت کیلئے ہے یا مندوب کیلئے ہے، اس لیے رسول اللہ ﷺ کی جانب سے علاج پر زور دینے کی وجہ سے علاج مندوب ہے۔
یہی وجہ ہے کہ ویکسین لگانا مندوب ہے کیونکہ ویکسین لگانا علاج ہے اور علاج مندوب ہے۔ ہاں اگر کسی خاص ویکسین کے بارے میں یہ ثابت ہوجائے کہ وہ نقصان دہ ہےیعنی اس کا مواد خراب یا کسی بھی وجہ سے نقصان دہ ہے، تب ایسی ویکسین لگانا حرام ہوگا،یہ اس قاعدے کے مطابق ہے جو اس حدیث میں ہے جس کو احمد نے ابن عباسؓ سے روایت کی ہے کہ رسول اللہ ﷺ نے فرمایا:
«لَا ضَرَرَ وَلَا ضِرَارَ«
"نہ نقصان دینا ہے نہ قبول کرناہے”
علاوہ ازیں،ایسا شاذونادر ہی ہوتا ہے۔ تاہم ریاستِ خلافت میں متعدی امراض سے بچاؤ کی ویکسین لگائی جائیں گی اور دوائی کسی شک وشبہ کےبغیر صاف شفاف ہو گی،اور شفاء دینے والا اللہ ہی ہے:
﴿وَإِذَا مَرِضْتُ فَهُوَ يَشْفِينِ﴾
"اور جب میں بیمار ہوتا ہوں تووہی مجھے شفا دیتاہے”۔(الشوریٰ-80)
یہ بات شرعی طور پر معروف ہے کہ رعایا کو صحت اور علاج معالجے کی سہولیات فراہم کرنا خلیفہ پر فرض ہے۔ رسول اللہ ﷺ نے فرمایا:
«الإِمَامُ رَاعٍ وَهُوَ وَمَسْؤُولٌ عَنْ رَعِيَّتِهِ«
"امام نگہبان ہے اوروہ اپنے رعایا کے بارے میں جوابدہ ہے”
اس کو بخاری نے عبد اللہ بن عمرؓ سے روایت کیا ہے۔ یہ عمومی نص اس بارے میں ہے کہ صحت اور علاج معالجے کی سہولیات فراہم کرنا لوگوں کے معاملات کی دیکھ بھال کرنے کے حوالے سے ریاست کے فرائض میں شامل ہے۔
صحت اور علاج کے حوالے سے خصوصی دلائل بھی موجود ہیں۔ مسلم نے جابرؓ سے روایت کی ہے کہ انہوں نے کہا:
«بَعَثَ رَسُولُ اللَّهِ ﷺ إِلَى أُبَيِّ بْنِ كَعْبٍ طَبِيباً فَقَطَعَ مِنْهُ عِرْقاً ثُمَّ كَوَاهُ عَلَيْهِ«
"رسول اللہ ﷺ نے اُبی بن کعب کے پاس ڈاکٹر بھیجا جس نے اس کے رگ کو کاٹ کرپھر اس کو بند کردیا”
الحاکم نے مستدرک میں زید بن اسلم سے، انہوں نے اپنے والد سے روایت کیا ہے کہ :
«مَرِضْتُ فِي زَمَانِ عُمَرَ بِنَ الْخَطَّابِ مَرَضاً شَدِيداً فَدَعَا لِي عُمَرُ طَبِيباً فَحَمَانِي حَتَّى كُنْتُ أَمُصُّ النَّوَاةَ مِنْ شِدَّةِ الْحِمْيَةِ«
"عمر بن خطابؓ کے زمانے میں میں شدید بیمار ہوا عمرؓ نے میرے لیے ڈاکٹر بلایا جس نے مجھے بھوکا رکھا اور شدید بھوک کی وجہ سے میں کھجور کی گٹھلی چوسنے لگا”۔
رسول اللہ ﷺ نے حکمران کی حیثیت سے اُبی بن کعب کے لیے ڈاکٹر کا بندوبست کیا اور دوسرےخلیفہ راشد عمر بن خطابؓ نے اسلم کے لیے ڈاکٹر بلایا۔ یہ دونوں اس بات کی دلیل ہیں کہ صحت اور علاج معالجے کی سہولیات رعایا کی دیکھ بھال کی بنیادی ضروریات میں سے ہےجن کی ضرورتمندوں کیلئے مفت فراہمی ریاست کی ذمہ داری ہے[۔جوابات سے منقول اقتباسات یہاں ختم ہوئے۔
خلاصہ:
1۔ویکسین لگانا فرض نہیں بلکہ مندوب ہے
2۔اگر اس میں نقصان دہ اجزاء ہوں تو اس کو لگانا حرام ہے
3۔ اگر اس میں نقصان نہ ہو مگر ناپاک یا حرام مواد ہو تویہ مکروہ ہے حرام نہیں۔
4۔مسلمان کو پہلے مباح دوائی تلاش کرنی چاہیے اور اگر نہ ملے تب مکروہ دوائی استعمال کرناجائز ہے۔
5۔لہذا آپ کے سوال کا جواب مندرجہ بالا کی روشنی میں یہ ہے:
ناپاک اور حرام مواد پر مشتمل ویکسین لگانا جائز مگر مکروہ ہے کیونکہ ویکسین دوائی میں شمار ہوتی ہے اور ناپاک اور حرام اجزاء کو دوائی کے طور پر استعمال کرنا جائز مگر مکروہ ہے جیسا کہ اوپر وضاحت کی گئی۔۔۔۔ تاہم اگر یہ ثابت ہوجائے کہ یہ نقصان دہ ہے تو اس کا استعمال جائز نہیں۔
اب تک میں اس دوائی کے نقصان دہ ہونے پر کسی قطعی رائے تک نہیں پہنچا ہوں، اس لیے میں اس معاملے کو شباب اور شبات کے لیے چھوڑتا ہوں، وہ مذکورہ کی روشنی میں اپنی صحت کے حوالے سے اطمینان کرلیں، ہم اللہ سبحانہ وتعالی سے دعاگو ہیں کہ وہ ہمیں اور تمام مسلمانوں کو ہر مرض سے بچائے، وہی دعا سننے اور قبول کرنے والا ہے۔
